Driving ban query.

    Just over 3 years of a 5 year ban completed for drug driving. (commenced Aug 2017)
    Previous convictions for drink driving, all over 10 years before aforementioned offence was committed.
    Never had a full licence just repeat provisionals.
    Upon cessation of this ban would this hypothetical individual have to complete lessons and a driver theory test to once again obtain a provisional licence.
    Asking for a friend, I dont condone such behaviour nor do I feel the need to discuss it.

    Not sure if you'd have to complete theory test and lessons, but you can apply for licence to be restored early. https://courts.ie/restoring-driving-licence

    A learner driver hasn't got a full licence to restore, so to speak, but a learners permit. Can a judge restore a licence that doesn't yet exist?

    The disqualification provisions apply to provisional licences as they do to full licences. The effect of a disqualification order is not that your licence is cancelled; it is merely suspended for the duration of the disaqualification; it comes back into effect automatically at the end of the period.

    Unless, of course, it has expired during the period. In that event, at the end of the period, you need to apply for a renewal, and do all the things you would have to do to get it renewed in any other circumstances.

    The provision allowing you to apply for early removal of disqualification applies to provisional licences in the same was as it does to full licences.

    I know this is pedantic and neither do I wish to be on any high horses but it's a Learner's Permit not a provisional licence. The reason I mention this is the OP friend doesn't seem the most responsible sort and should be on notice that driving unaccompanied has seen a bit of a crackdown in recent years. There are now provisions to issue FCPNs and seize the vehicle.
