Employer tax underpayment

    My employer claimed he has been under deducting my tax and took a random amount back in one go without providing evidence or any form of payslip. Regardless of the lack of payslip, can an employer simply take excess tax deductions without prior notice?

    Employer doesn't really deduct tax, revenue payroll notices in payroll software calculates this and employer withholds it and passes to revenue. You need payslips.
    How much have you earned and how much were you deducted. Sounds ropey to me not giving payslips

    My basic tallies with what goes into my account after tax so there's no issue there, he told me today his wife was doing the tax and under deducted me but he hasn't worked out how long for. I'm down about 33% on this two week period, I only seen the amount after I was talking to him.



    I looked on there https://www.workplacerelations.ie/en/what_you_should_know/hours-and-wages/deductions%20from%20pay/ but I haven't found exactly my situation. I will see him tomorrow so I want to be able to hit him with fact and be then able to get him to transfer it straight away.

    Your basic would be gross unless he promised you some sort of net wage which sounds v ropey indeed in this day and age.
    As everyone has different tax credits, no employer can accurately guess anyone's take home pay. Revenue supply the credits info and he /his wife applies them. PAYE is real time now so, while there may be teething problems, it sounds like they're not doing things correctly.

    Yeah sounds ropey. We had a few young lads come work for us in last few years and they wanted to know the pay rates net of tax, which I couldn't and wouldn't promise them. Turns out working for small tradesmen etc they had no knowledge of or interest in the tax system. I'd say it was all off the books for them with previous employers.
    OP you need to ask for payslips and try figure it out, it's not an unusual request, you are entitled by law, to them.

    I used a calculator from Deloitte based on the last budget, the net pay tallies roughly with what others I know in the trade are on.

    But he doesn't know your personal circumstances. You could have claimed credits or indeed you could have let credits be used by your wife etc. It's not something an employer can know. Tallying has nothing to do with it unless you're sure they have the exact same circumstances as you.

    Lack of payslips is a big no-no with Revenue. Have you registered online with Revenue yourself? You should.

    Big, massive worry for you here is if he does not pay the correct amount to revenue, you will be liable for the shortfall, and will have to pay it. You need to get it sorted and if you're not comfortable get an accountant on the case. It will not costly and give you peace in mind.
