Bought a puppy on gumtree, it isn’t the breed we were told and just a mix. Was microchipped and know the guys house. Not happy were were lied too and feel this dog will be bigger than we planned.

Advice please if possible...can I take action on the seller.

Probably not what you want to hear, but the dogs most likely healthier than the one you expected. Could you fall in love with the pup and live with it?

In Ireland there is no easy way to get money from people who don't want to pay. Big companies regularly write off debts because of the difficulty in getting money from debtors. A person selling a mongrel as a pedigree knows this.

The OP made their issue clear, that the mixed breed dog could turn out to be larger than the one they had planned for and were familiar with it's needs/temperament and other traits. This is a very practical and relevant issue that can't necessarily be ignored, and I do hope that the OP has the concern for this reason and not the dog's aesthetic appearance but either way if it's not going to work for them it's not going to work, if it will cause problems down the line much better to deal with it now before the dog is attached.

What is it? What was it supposed to be? Do you have any photos you can post?

Did you do any research on the breed at all as you did not recognise it was not the breed you wanted?

With all due respect, nobody in their right mind buys a dog off gumtree. It is rife with scams. You were lucky the dog even existed at all. Buying pets in the current state of affairs in this country is not recommended at all.

My post was just a friendly proposal/question that has some relevance, I don't think I was going against the charter, if you're a moderator feel free to take action though.

Meant to be a beagle but has very long legs for a puppy. Everyone saying it is so not a beagle.,

Do I have grounds for legal action against the seller

  • Registered Users, Registered Users 2 Posts: 6,995 ✭✭✭Cherry Blossom

Was the pup sold with IKC papers? Beagles are not small dogs. Max desireable height at the withers is 16 inches. Who are these people who say it’s not a beagle? Are they breed experts? To be honest you have very little grounds for a case and none if you’ve no ikc papers.

No IKC papers ....I don’t accept being lied to lightly

    That's so awful for you.

Expecting a certain type of dog and getting a different one. Have you tried ringing the Gaurds? How much did you pay on Gumtree? Don't bond with the dog or you won't be able to give it back. Let it know it is inferior and not up to your high standard of hound. Maybe consider posting it back to the seller via DHL or parcel express.

I've heard about a new site where they build you a customised robot dog with customised artificial intelligence. A bit pricey but, OP, I feel that this is the way for you.
Good luck with it anyway. Hope you eventually find that perfect animal you are looking for.

The issue is not the dog, we have that now, it’s not letting con artists a2au with stuff, I’d pay lots more if there was a legal way to pull a liar up.

You bought a puppy off gumtree with no papers, have no clue of its lineage or pedigree and are assuming it's not 'purebred' because someone said it's legs are too long,?

    You have zero case.
Suck it up and learn your lesson. Buy from reputable breeder in future.

PS. The guy you bought from is not necessarily lying either. Full breed dogs do actually come in different varieties of the breed, if you wanted specific breed traits only a professional breeder with line tracing can provide that.

If the dog is a mixed mutt rather than the pedigree specific breed then I understand why he is peeved. At best OP you could threaten him with reporting him to revenue which would probably get more traction than the gaurda or anyone else. If you have a screengrab of the ad or some kind of witness to the payment you could have a hope of getting them to refund you and handing back the puppy using the I’ll inform the authorities and revenue way.

You might come back minus your teeth of course, Seriously.

Otherwise try and sell it on or learn to love it. I hope you might love it and treat it kindly even if its seller was a lying skank.

Can you out up a pic of the pup?

Do you have any sort of receipt? Without it the seller is likely to swear blind he’s never seen you before and you won’t have a leg to stand on.

I have the change of ownership document for the microchip signed by him and records of a number of calls and texts. We also interacted with his neighbour looking for his house...don’t think the neighbour was his best buddy.

Have the vaccination record and the name of the vet that done the firs vac for him...we done the rest.

Similar happened to my parents when they went against good advice and bought from a breeder rather than rescuing a dog.

They still adored the dog until she passed away last Xmas. What mattered was the dog herself, not how she looked or how long her legs were.

You got scammed, OP. That sucks. But I also have little sympathy for people who are breed driven rather than rescuing a dog from being out to sleep. That also sucks.

Just make sure that whatever action you decide to take, the dog in no way suffers harm or hurt.

On the question of taking legal action you would need to prove that the pup is not pure bred and that it was misrepresented to you by the seller.

... and you can't do that without papers, real or forged.
(Edit) misread the "... prove that the pup is not pure bred ..."

Most puppies have legs/paws disproportionate to their body size, plus if it's not a purebred with papers listing it's lineage then it's a lottery. Any submissive gene from a past generation could suddenly pop to the fore. Here's hoping there isn't a Great Dane/Beagle cross somewhere back there.

Seriously though, just love it... think bad of the seller but don't blame the dog.

You could try over on the Legal Discussion Forum.

OP; forgive me if I am reading this wrong; thank you.

But you have the opinions of ??? breeders? that this is not a genuine pedigree dog? Of experts? Maybe if you put a photo up here? We have some skilled folk here and a few posters are not convinced there is a problem?

I personally don't see the point in complaining if you didn't go for an IKC registered puppy...

Well, despite several requests there’s still no photo of the puppy so that someone here familiar with the breed could give an opinion.

Excellent news, excellent attitude, feic knows what would have happened to the pup if you'd have given her back to the seller.

Stick up a few pics if you can. Can't blame you if you don't want to to be honest. Either way, enjoy the new family member! Get used to looking at the back of her head every time you try and do a bit of DIY!!!

I would take this experience as a sign that you were meant to have this dog, and that she was meant to be yours.
Gumtree is rife with people buying dogs specifically to breed them for profit, to fight, or to be used as bait for larger animals.
That poor pup could very easily have ended up in the hands of someone like that, but she luckily ended up with you in your home.

I don’t blame you for being annoyed at being scammed, and I obviously don’t agree with buying and selling animals online, but at least this story has a happy ending where a puppy has ended up in a good, safe, and loving home.
The rest of her litter may not be so lucky.

This is the kind of post that gives this forum the reputation it has - essentially a hostile place unless you conform to the forum narrative: the only place to get a dog is a "reputable" breeder or one of those rescues that have policies that require you to leave your first born as collateral.

Of course it's an attitude that's fill of hypocrisy: purebred dogs are inbred dogs and even the best ones have genetic defects from this breeding - yet that is never condemned here as a cruel practice as long as they are "reputable".

And as for rescues: it's not as if these places are above reproach either. There have even been cases where they have been found to be mistreating animals.

You can get good dogs in other places other than breeders and rescues.

So perhaps timeladsplease and others, wind the sarcastic posting in or you'll be left with the same quiet forum that will eventually die off because of this attitude.

Dog "breeds" are a human construct. Be happy with your dog and treat it as you would any dog.
