Car under finance - various issues with car

    Please feel free to move if in the wrong forum.
    I bought a car for approx €14k from a dealership under finance in June. I have had to bring it back on 3 seperate occasions due to a recurring issue that they said they’d fixed, along with 2 new issues.

    I now have lost all faith in the car, and to some degree the dealership also. I’m not in any way confident that they’re going to fix this issue for the final time and for it to be drivable and in merchantable condition.

    The reason why I’m posting is that I want to know my rights -

    - can I refuse to accept the car back because of the issues and not feeling safe, and request a replacement?
    - can I contact my finance people and let them know of the issue and see if they’ll let me walk away from the car and finance?

    Do I have any other rights? I screengrabbed this from the citizens advice site and I’m hoping this Information will let me get a different car. If you’ve been in this position before, what did you do?

    Are they major issues? Is the car under manufacturers warranty or from dealer? Did you buy from a main dealer of the brand of car you bought?

    Need more info on the issues. I worked for BMW once and a woman wanted her money back on a used car because we couldn’t fix an issue she was having with getting 3 punctures in the same month :)

    My mother wanted to trade in her car once because she got 2 punctures one after the other, different tyres too

    She did in the end but she hated the car anyway. She did get a BMW though, an i3 which my father wanted really, not her.

    Issues are a recurring noise coming from the engine, an issue with the lights and the engine coughs and revs fly up on the speedometer when it’s between 1500 and 2009 revs.

    Bought from a dealer and it’s not under manufacturers warranty, just dealership warranty

    The issues with the car are nothing to do with the finance company. If anything, it just makes it more awkward to change it.

    As regards getting the car fixed, that’s what you’re warranty is for.

    You could just demand they take the car back and see where that gets you, but that’s just up to the goodwill of the garage.

    I’d contact the finance company ASAP and see what your options are. They should have a process in place as they too have certain obligations towards you. Per citizens information;

    Anything you buy under a hire purchase agreement must comply with the Sale of Goods and Supply of Services Act 1980 and be:

    Of merchantable quality
    Fit for its normal purpose, and reasonably durable
    As described, whether the description is part of the advertising or wrapping, on a label or something said by the salesperson.
    If goods hired under a hire purchase agreement are or become faulty, both the retailer and the owner (finance company) are responsible. A consumer can claim against either party in this situation. A claim cannot be made against the manufacturer of the goods.

    Whatever you, don’t stop paying out of the blue because you’ll end up with your credit rating destroyed for years.

    A bit vague but in fairness they sound like things that you would be entitled to get fixed under warranty. Have they given you any explanation for the issues. Is it HP finance or personal loan finance. What make of car/year/mileage.
