Car not serviced as promised

    Looking for some advice please .
    Traded in our car for a new 2nd hand car with a SIMI dealer.
    Was promised that car would be fully serviced with whatever was needed .
    Now have the car and following checks can see that the Air filter and oil definitely not even Changed. Can assume cabin filter , fuel filter and oil filter likewise .

    Would it be worth getting onto SIMI about this? They have lied through their teeth so really am considering canceling the deal .

    Any advice welcome , thanks

    When will you be collecting/paying for the car?

    Do you know from the records when it was serviced before now?

    Very unlikely you can just hand the car back.
    Do you know when it’s due a service next? Some cars are on 24 month schedules.

    Is it a diesel car? Oil in a diesel is generally berry black after a few miles following an oil change, doesn't stay clean as a petrol car.

    Diesels don't dirty air filters quickly though. That is the surest sign of all.

    I think we need some sort of a bulletin on this. SIMI aren't a consumer support group. It's a lobby group for the dealers, so their interests are brought forward politically.

    I'm not trying to be smart. I'm trying to understand what prompted checking the air filter and oil after buying the if it wouldn't occur to check them before hand. I get it that many people don't check these things before collecting a car but the same people wouldn't check these things afterwards either. Were they only checked when it was being serviced? If so how long was there between buying the car and you getting it serviced? Or is there an issue with the car where these things are now coming to light? I'm just trying to join the dots here.

    How do you know for certain it wasn't replaced? Genuine question.

    "Whatever it needs" is a dangerous term between salespeople and consumers as both expectations are usually very different.

    For example if the used car has 75k kms on it, you might assume it would need an air filter and the air filter may be soiled but if the manufacturer says it doesn't require an air filter until 90k kms then the salesman wont be replacing it.

    I'd make treble sure of my facts before going in all guns blazing. Any good dealer should stand over any bad decisions. Maybe you've misread the signs and it's serviced to spec, maybe there's been a genuine issue on their end that they'd be glad to rectify.

    The first thing I would do is to contact the SIMI and register a complaint with them regarding the way your dealer has treated you.

    I would then write to the managing director of the dealership pointing out the fact that you agreed to the purchase of the car on the basis that it would be fully serviced. I would demand that the dealer supply evidence as to what if any service work was carried out on the car before you accepted it.If they fail to do this or do not offer to have the car fully serviced I would notify them that you intend to cancel the deal as the dealer is clearly in breach of contract.

    "Fully serviced" means different things to different people, conveniently.

    If the car is at 74k km, and a service is needed 75k km, then by the manufacturer's own definition, the car doesn't need anything, and is fully compliant to their servicing requirement.

    How much was the car?

    Lodging a complaint with SIMI will get you absolutely nowhere.

    Find your cars recommended service schedule online.
    Compare against your own car's records.
    Call the salesperson, and politely let them know that you've been misled and and ask for a resolution.
    Voucher for a free service when it's due seems fair to me.

    Ok , in the end I arranged for Fuel , air and cabin filters to be replaced by a dealer more local to me .
    I also paid for new oil and filter myself . They were adamant this was changed but to eliminate doubt decided to take the hit on that .
    Lesson learned and as pointed out here - fully serviced can mean different things - will know better next time and have it all in writing as to what I expect to be done .
