Hi I wont go into too much details but dealing with a family law solicitor who seems to be inconsistent with what she says everytime I talk to her. There was a few letters back and forth and my ex claims we have not being responding which as far as I am aware we are. The solicitor encouraged court and booked the date, its 2 weeks away and from the language in conversations through text with the ex I dont think she has got a summons or is aware. I was expecting a counter court summons for maintenance but it hasn't come

Just wondering could my solicitor be spoofing me a bit, i was a bit frustrated today after talking to her as her position seemed to have gone 180 from the last time and she was saying the complete opposite with key areas of contention

    Mod

Any/All professions have good and bad people, some solicitor have been convicted on criminal offenses in the past, but the bad apples are always a very tiny minority of the total profession.

Perhaps on reflection and the benefit of more knowledge/time, she reevualated her position.

Perhaps on reflection and the benefit of more knowledge/time, she reevualated her position.

She should not have proffered a definitive position or initiated action until she had undertaken a review of the clients specific circumstance and proposed action.

IMHO any competent Solicitor who is uncertain of an immediate opinion will always advise their client that they will review the clients position and give a fuller opinion once they have reviewed the legislation and case law.

If a Solicitor is presenting definitive and actionable advice, and then reversing their position on that advice?
That could point to a competence issue IMO.
