?how long does it take to join another party to an action

    Would anyone know how long it takes to join another party to a legal action? Also who pays for this, the defendant requested this but it seems my side have to do work which I know I will be charged for.

    I issued an action last August, we asked for their defense and then they requested we join another party to the action which my barrister allowed. However nothing has happened since so nearly a year after an action has started I have got no defense from the defendants. Is this normal time frame or is my solicitor incompetent? i would have thought adding someone to the action would just be a case of adding their name down.

    Even if the party proposed to be joined consents it has to be done by a Notice of Motion based on an affidavit. (usually preceded by a letter ) If contested Motion may be adjourned for a hearing. Can be delays along the way for various reasons.

    Just be clear, it was the defendants who asked for the other party to be joined not me. so basically 11 months ago I started an action against my neighbors for tresspassing yet I have not got a defense as to why they think they can.
