Arrested but not charged with anything

    So I was arrested before but not charged with anything at the time. Basically just told to wait to hear back.

    It was to do with 2 people sending me money and I never sent them the item.

    The gardai arrested me in December and took statements,

    I have returned the money in full to the people now.

    Haven't heard anything back in relation to it.

    What happens?

    I'm going away for 2 months this Summer. Will that affect it? will I have to return for a court date?

    Should I call the gardai and update my statement to let them know I have now returned the monies in full to both people and hope they drop it?


    Just confused as I've never been in this situation before.


    Thanks in advance, and please no negative comments, I've never done anything criminal before and will never be doing anything similar again.

    Where are you going for the summer?

    There's a big backlog of court hearings for non serious offences so you could get a summons yet. It's a bit strange though that you hadn't returned the money at the time but they released you without charge.
    Did you admit to it? What exactly did they say when they released you?

    Yes I admitted to it, it was my first time dealing with anything with the Gardai, I held my hands up and completely admitted it, apologised etc and told them I'd get the money ready to pay the people back.

    That was in December and I didn't hear a thing from them.

    I paid the people back recently and im thinking of ringing the guards to update that onto my statement.

    Just not sure what happens next and it's hanging over me, the uncertainty!

    They basically arrested me and took my statement at the station etc. Gave me all the legalities yada yada sign this you can be detained here for 4 hrs bla bla.

    The officers I was dealing with also advised me they'd recommend I send the money back etc.

    No charge, they told me they'd be in contact in a few weeks or a month or two. Now it's basically July

    Where are you going abroad? You might have visa problems if it's on your record.

    Sounds like they've possibly dropped it though if they didn't charge you.

    They'll get to you don't worry. We've just been through almost 4 months of lockdown.

    Awaiting a case myself. Court date set for April, cancelled. Set for June, adjourned. Now set for September. Hilarious case of an 'incident' that took place in June 2018.

    I was told they are trying to keep numbers to a minimum at court houses so non-serious cases will drag on for quite a while yet.

    Go on your holiday, the court clerk will get it adjourned if you show them evidence of your flight bookings.

    Im going to Spain, from Ireland so won't need any visa etc

    Yeah I don't think they've dropped it just not sure why they haven't got back to me. Do you think if they know I've paid them back they could drop it? That's what I was kind of hoping.

    He wasnt convicted in a court so there will be no record when it comes to Garda vetting.

    He was only arrested. Not even charged.

    How much was the taxi fare? Did he try to pay it on the phone once he had regained the pin?

    Weren't you a naughty girl? Tbh I'm surprised the gardai tracked you down and arrested you, unless the amount you stole was substantial because normally you hear when someone goes to the gardai to report a "Done Deal scammer", the guard will say that's a civil/consumer matter, nothing to do with us.

    Garda vetting is based on more than actual convictions, it's broader than that, however in this case it is highy unlikely the OP will hear any more about it now that the money has been returned unless it was an elaborate scam rather than the OP being a gob****e

    Garda Vetting will only show convictions and pending prosecutions, ie: something that is currently in the court but not yet resolved. In the OPs case, there has been no summons or charge as of yet, so it wouldn't show in vetting. Only once there's a conviction or a charge/summons executed and still before the court would it show. In the OP's case, neither has been issued (as far as we are aware of) so it wouldn't show in vetting, and they can travel freely (albeit leaving the country while under investigation could be dodgy looking, depending on the details of the case). GOing to Spain for 2 weeks shouldn't ring any alarm bells, considering you've no previous interactions, and again depending on the amount/methods involved.

    OP, no harm in ringing and looking to speak to the investigating Garda. Even if you don't have a name, they can find out who the investigating member is and pass on the message/request for a call. It's possible that the injured parties might withdraw after recovering the money, and a simple statement to the Gardai will resolve that. But you'll never know if you don't try and find out.
