Water pipe right of way

    I use a shared right of way with 3 others. Its a private road, I own the ground under the road itself as it shows on my land folio.
    Question is, can one of the other 3 users dig and put down a water pipe (from the main road) along this road or do they need permission? Or would they need to get some form of legal right of way for the water pipe?

    Sounds like they already have it done? yes they needed your permission before doing anything would be my understanding.

    There's one already in place and its noted on the folio. The new one would be for a newbuild house in the road

    Yep i know of a developer charging 250k to another developer for a foul sewer going down his road.
    The guy charging built the road and owns what lies beneath.
    The guy getting screwed has to stump up another 250k to Irish Water so is getting doubly screwed.

    Different situation altogether i know but if you own it you have the say.

    Id say you could name your price in that situation. If they want it bad enough theyll pay.

    In the situation i explained the guy hasnt budged yet and is having to pump foul into a tank until he resolves the matter! Nightmare!

    Who owns and maintains the existing water line?

    We have an old CPO Co Co water main crossing the land. A pure nuisance, springing leaks which may not be noticed for some time during Winter months. Silage trailers and heavy slurry tankers pass over it and create leaks as well. A crew come along with a digger and unless watched will leave a mess of bare ground after them. Although I must say they located and repaired one of our own leaks which saved a bit of hassle.

    How long is the private road and in what condition is the road and is there any hedges. New builds on private roads can be problematic. Who is responsible for maintaining road currently. Who installed the water pipe there already.
