    Hi I just about to start a small claims against Parcel Motel. One of the pieces of information I need is their correct name and address. Parcel motel is run by Nightline which is now a UPS company. Any idea which company should be on the claim?

    Would it appear on the relevant invoice to you maybe?

    As a preliminary matter, are you satisfied that it is you who has the contract with them? I.e. You engaged them, and likely paid them directly to move or store goods for you?

    There's no invoice, the parcel was delivered to them, signed for, went missing turned up in their warehouse 3 weeks later box open items missing. They're washing their hands and saying I should claim off the original sender.

    Not sure what Dave and John can bring to the party here. Neither have been Directors since mid 2017.

    I suspect even if they were still involved, it might not serve the OP to bring them a query relating to a small claims matter.

    OP, have you considered your options in the round on this? As far as I can tell, COMREG may have a role in this as the regulator. I am in the process of making a complaint to them myself. Don't fancy my chances in the Small Claims Procedure.

    Sounds like theft in their Depot. Report it to the Guards. UPS HQ won't be very happy with a police investigation into their staff stealing items out of parcels.

    I wasn't aware that they personally had left to be honest; lost out of date website :)

    All I was thinking of here was to contact them or their equivalent to state that you need to send correspondence to the firm, ask nicely for a contact name and details and take it from there.

    So the contract of engagement here is between the person you purchased the goods from and the courier who they engaged to deliver them to you.

    SCP are unlikely to touch this. Can you not get back on to whoever you bought the goods off and tell them they have arrived damaged / partially missing?

    No it isn't actually, The person I purchased the goods off delivered it to Parcel Motel. That was the end of their obligation. My problem is that the parcel went missing for 3 weeks with parcelmotel also they signed for it.

      Yes, but whom paid Parcel Motel for the delivery, you or the sender.

      If the sender paid, then Parcel motels contract is with them, how expensise is the item, normally they have a limited insurance.

        I paid parcel motel to redirect the parcel to me.
        It was about 200 euro but they're denying all responsibility.

        Ok, I understand now. You do indeed have a contract with them so. Will you be able to demonstrate that the damage / missing items occurred while they were performing for you? I.e that the parcel wasn’t in ****e when they first received it from the sender?

        I checked their website and found the following, so this likely the company; Nightline Logistics Group (“Nightline”) is a company registered in Ireland number 181961 and whose registered office is at Unit 5 Mygan Park, Jamestown Road, Finglas East, Dublin 11, Ireland.

        I believe that as they didn't sign for it as open and empty ( in their words) and it then it went missing for three weeks would be enough. It's four weeks now and I still haven't even received my "empty box".
        I wonder if I could call the Guards and report the theft?

        The missing for three weeks certainly helps. Wouldn’t think the Garda will be particularly interested. There is very little evidence to suggest a theft has occurred. It’s a damaged box that items have fallen out of, at a time when couriers are trying to cope with record levels of business.

        Small claims action may encourage them to engage, but they are likely to just offer the basic insured value of €100. Looking at the website that is the terms of the service. Is it worth investing several hours and another €25? Keep contacting them maybe and try and try and have them pay the insured value.

        Annoying I know.

        "have being advised the parcel arrived into our depot empty unfortunately as the item passed through a number of channels on its way to us it would be hard to determine where the item came undone from the packaging therefore I would not be able to pass this for claim on this ocassion"
        Still no answer from them on why they accepted an empty open box from Hermes. Also where was the parcel for 3 weeks after they received it?

        Yeah. For the reasons you give their evidence to the effect the package arrived already open and empty is not terribly plausible. But you will need Hermes to give evidence to the effect that they delivered a package containing the goods you had purchased. Once you have this, head off to the Small Claims Procedure and I would say your chances of them being found liable are good. However you might have a problem with the amount you can recover, if as another post in the thread suggests their T&C cap this at 100 euros (unless you pay for a higher level of cover).
