Dog and Sheep law

Just a question I was hoping someone could answer.


After a dog has mauled sheep and farmer is certain of the dog responsible as in caught the dog in the act but did not shoot the dog. Apart from liability costs etc what happens with the dog?


Can the farmer insist the dog is destroyed?


I am curious of what the law is here, I know if a dog bites a person it can result in the animal being put down.

It is dealt with under S22 of the Control of Dogs Act 1986, aka the "Dangerous Dogs" section.

So it is really up to the court to decide.



it appears to the Court that the dog is dangerous and not kept under proper control, the Court may, in addition to any other penalty which it may impose, order that the dog be kept under proper control or be destroyed.
