Rolling contracts

    I'm working as an IT contractor through an agency. The contract I had with them expired in 2019, but I've continued in the role since then and have received payments as normal.

    The agency claims my contract is a "rolling contract" though the contract I signed clearly states the engagement ended in 2019, and no mention of rolling contract is in there.

    There are clauses in the contract I'm having issue with and I would assume I'm no longer bound by these any more since the engagement has ended, even though the role is still ongoing.

    Does the fact that I've continued to receive payment mean that the original contract is still active, or would it have to have been clearly specified in my signed contract?

    Contracts don't need to be writing and both you and the agency continued to work on the same basis after the initial period, so yes there is a valid contract.
