neighbours drain flooding my land

    a neighbours drains are flooding my
    land here due too the want of a wee
    clean out approached them 3 times
    since new year and they seem to be
    not going to do anything about it
    anyone else ever have this problem ?

    I would think he can only have drains on his own land and it would be up to you to drain yours l know it might not be the answer your looking for but water flows down hill.
    Best talk to him and come to some agreement maybe a different outlet point from his farm

    If your neightbours drain has an outlet into your property, this is considered a Tort of Trespass and is actionable in a Civil Court.

    Is it flooding onto your land or stopping water leaving your land.

    If there is water coming onto your land I’d be thinking it’s yours to deal with.

    Are you up hill or down hill of him? It seem you are downhill but not that clear.
