Is BCMS up to date?

    A house opposite me sought and obtained planning permission, built up urban area within DCC area. Six months on; work commenced a month ago, reasonably clean but some annoying matters, blocking out 6 parking spaces but never using them for anything, working outside hours, eg Kilsaran cement truck pouring footings late at night immediately up against another house. In addition, they demolished a 6ft high 20m stretch of boundary wall which was shown as to be retained on the planning app. When the digger was knocking it, they had lads holding plywood boards in front of cars parked along the path to protect them. Not exactly H&S compliant, I imagine.

    There is no site notice up and there is no commencement notice on BCMS. Is that system fairly up to date? There are a few other sites underway on the street and the physical and online notices are in place.

    I don’t plan on getting further involved unless there’s a serious issue. However, work has clearly commenced (involving demolition of half the house, car port etc) and the commencement notice seems not to have been lodged. Formally, I think this means a retention application would be required?

    I've submitted a number of commencement notices on bcms but I honestly can't seem to make any sense of the search function so I'd find it very hard to say a notice isn't there. Maybe that is just the browser I'm using though.

    Planning issues are reported to Planning Enforcement. They have nothing to do with the BCMS.

    Late working.
    Knocking walls without permission.
    Late pours.

    They are planning issues.

    The H&S issues have to be reported to the H&S Authority. Building Control (BCMS) have no powers of enforcement here.

    There is no requirement for any site notice once planning is granted.

    Again, a retention application is a planning issue not a bcms issue.

    Also, the BCMS system would be running at least a month or so behind actual lodgements. And they were also having issues last week so it may have fallen back further.
