reclaiming area for sfp online

so my land area after remaining static for last 5 years has gone down for the 2020 application

I let them away with subtracting small areas before as it didn't affect the payment but this constant squeeze death by a thousand cuts in all areas of life horse**** is starting to piss me off.

This time around at the last stage the application is warning me I have less less land area than entitlements.....utter ****ing unnecessary complete pain in the hole but is it possible to submit a counter claim online for the areas that have been subtracted online (mistakenly in my view).....maps don't seem to be available for 2020 but even on the 2019 maps I can see chunks that have been removed, former roadway thats been field for the past 10 years, section of field subtracted for no apparent reason etc.....

anyway I'm down 0.04 of a hectare and I'm ****ed if I'm going to roll over and take it.....would anyone know how to go about correcting mistakes in the maps...can it be done via agfood or do I need to submit a hardcopy map with corrections marked, is there a format?

anyone gone through the process before? You'd think with all the difficulties this business has experienced over the past number of years they wouldnt still be squeezing.

You should have disputed any "over claim" at the time. I doubt you will have any chance of success retrospectively.

We were hit with 3 "over claims" in the last 6/7 years and we disputed each of them. DAFM sent out inspector/s and we succeeded in two of them.

IMO if you dispute an over claim ensure that you have all your I's dotted and T's crossed for cross compliance.

Can you submit the application when the system itself is warning you that you have more entitlements than land area? ....

I still think I'll dispute tbh ....theres a margin cut out of a field for what was a roadway easily more than 400 square metres alone.....just seems petty on their part

What happens in my case if I don't dispute, presumably I lose 0.04 of an entitlement back to the reserve?

    Maybe I’m missing something.
Can’t you just amend the online maps and submit your application as normal.

We did this last year and no problems at all.

Ill certainly give it a try.

Trouble is I'm not quite sure how to do it. When i go into 2020 application I can't see a way to access maps or amend them.

I can view the maps on 2019 application but I don't know how to amend them....is there an edit tool, do you simply grab their red border and extend it over the correct area/

I have had the same problem this year.
Like you I have the same amount of land as previously.

I phoned the Agfood.ie help desk and stated the problem I had with this years application.
The following was the advice I received.
On the bottom of the first page of Direct Payments application you have to click on either "I have Land change" "I have no land changes".
    Click "I have land changes"
On the next page that comes up you can change the area to what it should be.
It look likely that they may look for proof.
I discovered at least One and possibly three mistakes on the Aerial photo.
For example where there is a road running through my land, near the end of the road the map incorrectly shows a length of two parallel roads.

a cheap way to get overgrown ground in order would be to get someone in with a flail mower or digger for a few hours

They drive me mad as well. You should listen to Ted Kaczynski's manifesto on the techno-industrial society and how the lack of autonomy leads to dissatisfaction with modern life. You can't act independently. There are bureaucrats that monitor you constantly that can intervene at their whim but you can't reach them at all.

Anyway when you insert a figure greater than the MEA you get an overlain warning. If you decide to continue with your massive claim you should see a text box where you outline the reasons for challenging their power and you should have now an edit map option. So now find whatever exclusion area they have increased in size to annoy you. You must draw an alternative one which will have a smaller area and matches the current state of the land. They will either accept your alternative exclusion area, ignore you completely and keep theirs or maybe send out an inspector. Good luck!

Forgot to add. Take a few photos of the exclusion area that show it to be smaller than they think. There is a place at the end of the bps form where you can write that you are adding supporting documentation. You can use the Correspondence Section to upload your photos in a pdf file.

Do you mind if I ask what did the area of the dispute add up to?.....eg 0.5 hectare or much much lower?.....

I'm thinking that with the area I'm disputing they might not give a ****e because it might not be worth it

also did you have to leave location info on the photos (embedded gps co-ordinates etc)

I'd put in the parcel map at the start of the upload file after putting in some arrows and letters A,B,C in a graphics program to show from which direction the photos were taken and then add photos A,B,C

About .01 of s HA. Yes I had to.leave location data embedded in the photos. Like you I was borderline for my number of entitlements.
