Leak from upstairs

    Live in the downstairs apartment and never had issue with leaks.
    Person moved in upstairs 3/4 years ago and had issue with the balcony holding the surface water.
    They got a tradesman in and I believe they added more concrete to the balcony in order to remove the surface water.
    We are not experiencing minor leaks while upstairs is experiencing something a little more severe.
    The management fund is meant to cover any structural issue.

    My question what is the best course of action?
    Both apartments would have insurance for the apartment and the management would have overall insurance
    • Is the best course of action?
    • Get a builder in to view and fix it.
    • Should we notify the management company?
    • Should we contact our own insurance companies?
    I can't see how any of this would fall on my side as (a) it is more than likely external and (b) the issue upstairs is most certainly caused by the upstairs apartment's balcony.
