CCTV - employee with the employers cctv cameras on his phone

    We found out that the guy on the other crew from us has the CCTV cameras to our workplace on his phone and he is logging in and viewing the workplace, one of the girls caught him 3 separate times doing that (in the workplace), it's just getting creepy , I don't want to give out too many details as it might identify where we work, but he seems to know what is going on even when his not there and we do feel very uncomfortable about it, he has been employed a lot longer than us and we have not said anything to the employer, the boss must of gave him the login details to the cameras (we have a outside security comp looking after cameras as well) the boss must of given him permission to view us in the workplace, why else would he have the cameras on his phone, (but why not on the company computer, they could use a pw so only they have it) we have no problem with cameras as it's security for us but to have that guy monitoring us when ever he wants on his phone, is just not right. our boss must of gave him permission, can he do this and should the employer of allowed it, should we say something or just get on with our work

    Does the workplace have signage up to say CCTV is in place? Does your contract mention CCTV being in place?

    It does have signage up in reception but there is but not in the whole building and not everyone comes into reception, I don't know if the other workers outside know

    You need to find out who in the company is the designated Data Controller for the data captured by the cameras.
    If it is the guy with the phone then ok.
    If not they are breaking the law.

    Unless he is a key holder or manager I don’t see how he should have access to the cctv system at all. I would definitely bring it to the bosses attention because surely a regular employee shouldn’t have access to it .. it’s a security risk and maybe a GDPR issue also. There are fairly strict protocols around the use of CCTV in the work place and how the recording are kept and who has access.

In particular, CCTV should not be employedin areas where employees spend their free time unless it can be justified, for example, based ona need to monitor safety and security. It is generally considered that the threshold for justifying the use of CCTV in breakrooms, changing rooms,and bathroom areas is difficult to meet.
    The use of recording mechanisms to obtain data without an individual's knowledgeis generally unlawful. Covert surveillance is normally only permitted on an exceptional, case-by-case basis,where the data are kept for the purposes of preventing, detecting,or investigating offences, or apprehending or prosecuting offenders.
