Survivors pension when marital status is separated

    My Dad thinks he can still claim a survivors pension after my mother died and they are separated. Surprising if true.

    Is your dad retired? Is he getting a state pension already? Or is he still working age?

    Retired and in receipt of pension.

    He probably will get it. The rules even allow for him to get it if they were divorced (providing he hadn’t remarried or be living with someone else (co-habiting)

    EDIT: if he’s receiving a state pension in his own right he won’t get this. It’s one of the other when it comes to state pensions

    If he already has a max contributory pension then he cannot apply for a widows pension as well.
    However, if he is on a reduced con pension or even a non con pension, and your late mother was on a max con pension then he would apply for a con widows pension and he would get the max amount.
    How much pension is your dad getting?
