work lotto syndicate to be culled

    I been a member of our department work lotto for 3 years and always been paid my fee in advance . I was told in december that the group was being cut becsuse there were too many in it and I was one of those not to be part of it in future. Surely if the new smaller group has a win in the future there will be possible legal implications

    What legal implications? If you're being cut out of it, you wont be paying anything towards it and not entitled to anything. Just do your own lotto or start your own syndicate. We have a syndicate in work that I choose not to be part of. Best of luck to em if they win

    Well, no. If you want to play lotto, you’re free to buy your own ticket. It’s a bit harsh to cut certain people out though, unless they were constantly in arrears. Did you ask for an explanation as to why you were being excluded?

    Why don't those being cut set up their own syndicate?

    I can't see there being any legal implications, it's probably just too much hassle for whoever is organising it. There's 2 where I work and I'd hate to the person in charge of collecting the subs.

    Are there official rules drawn up for the syndicate?
    If not, then you probably don't have any come back.
    It seems pretty shabby though - how did the gang decide who was in or out?

    You could always form a separate group with the other people who've been kicked out.

    isn't there legal precedent about syndicates. I recall a case where a syndicate who had won money were taken to court by a previous member who didn't contribute to the pot for a while. The ruling was that even though he didn't contribute he was still part of the syndicate and was entitled to his share of the winnings.

    it seems the original ruling was over turned ... but it does show that it isn't cut and dry just to remove a member.

    Only thing is if you're setting one up for those who have also been kicked out, it's possible they have been kicked out because of lack of payment/falling behind on subs and your rogue lotto syndicate could end up being a nightmare.

    Is there residual funds in the kitty that you would have contributed either through subs or your subs helping buy tickets that added winnings to the pot that is being retained by the syndicate after you’ve been booted out? If that isn’t the case, and the new reduced size syndicate will be starting with a clean slate then there’s no chance of legal recourse.

    If it’s the opposite and the syndicate is kicking out a bunch of people without paying them their share of what was in the kitty on the day they are kicked out then that’s a whole other story.

    No doubt anyone leaving (forced or otherwise) a syndicate, that at a later wins big would be in, trying their 'chances' to get a share of the dosh.

    Thus, the best solution to this 'gentlemans agreement' is via an actual written formal signed (with witness signature) agreement.
    This creates a formal document with names of players, and other terms±

    Having such an agreement in place helps prove to the tax man that payments made to syndicate players aren’t ‘gifts’.
    Also photograph and group-email any such document as further proof of agreement, same for any updates.
    Set out whatever ±terms you want, as long as they're generally fair and considerate 'majority' views e.g.

    Agree who the manager is, and where it's stored (they should be the one that singularly collects the prize, before distribution).
    Which games, draws, how many lines will be played?
    How and when will payments be made?
    What happens if someone misses a payment? {important}
    What happens if someone leaves the company? {important}
    How and when will prizes be shared – or will they be reinvested? {for smaller wins}
    Will the group want publicity in the event of a big win? {*very important*}
    How will/when the group communicate a large win?

    Ticket signing could wait until official collection ('activation') at lotto offices incase some with jam fingers makes a mess of it during office pass-around.

    We do our work syndicate via Revolut. Makes it easier on the organiser to keep track of things and no messing about with coins.

    I would think if you haven't contributed money, you are owed nothing.

    The simple solution is to make another syndicate.
