Got rear ended!

    So a girl crashed into my car from behind yesterday. Luckily i didnt have much of a damage on my car (few scratches on the bumber and some dents) but the bumber on her car got damaged quite badly.

    I wasn't exactly sure of the process so called Garda as a first step. They came and took details from both of us and then they gave me her details and gave mine details to her and told me to get the police report from the Garda station and then we all went our ways.

    I'm just wondering how the insurance process works. Once i have the police report from Garda do i contact the other persons insurance company and explain to them what happened? My insurance is only 3rd party so they wont cover the damage to my car.

    Can someone let me know what's the process i need to follow and how much i can expect to claim for this? This is the first time it's happened to me so i have no idea what to do here.

    Do you have their insurance details?
    If so, just contact your insurer and pass along their details, you dont need to do anything else, the insurance companies will handle it from there.
    (You dont need to wait for the Garda report, but you can give the details of station/report/Garda involved to your insurer)

    Since she rear ended you, then I would imagine she would be liable for any damage to your car, so the fact you only have third party should not be an issue when it comes to getting any damage to your car repaired. Her insurance should pay out for both cars – but that’s just my understanding. Your own insurance company should be able to better advise you- i'd call them as soon as possible to get information.

    First of all, don't underestimate the damage, it could be much more significant underneath.

    Go straight to their insurers, they will have a list of approved repairers and if you can accept the repairs being done by one of these, it will be the quickest way to having your car back on the road. Some of these have car rental collection on site for a replacement car.

    Regardless of where the temporary replacement car comes from, given that you only have third party, you need to insist they provide comprehensive cover on the rental car, you don't want to be responsible for anything that may happen to that. They'll try and get you to transfer your policy and increase to comprehensive for the duration but if you hold firm, they will cover you on rental car policy.

    I would just contact your own company and get advice from them. Her insurance should be paying out on any damages to your car, not your own company. But they should be able to advise you on all aspects of the incident, including getting your own car repaired. I was involved in a similar accident about 10 years ago and I only ever contacted my own insurance.

    Contact your own insurance company and let them know but because you’re third party they won’t help with getting your car fixed.

    To do that you’ll have to ring her insurance company and lodge a claim.

    You report the matter to your insurers for record purposes only. They will have no involvement in your pursuit of the 3rd party for your loss. Ring their insurer, explain the situation and hopefully the other driver has already reported the matter and accepted liability. You won't be issued with a report by Gardai, so make the call now. The other insurer should arrange a courtesy vehicle for you, if required. Rear ends are straight forward

    Called the company with which the other company was insured with, they mention they don't have this policy number or the Car Registration in their system! Garda took the details from both parties (car reg no, insurance no etc) and provided to the other party so i don't know now if the other person's car was actually insured ! Also Garda didn't give me her license number so i assume she didn't even have a license !

    Will call Garda up to see if they can provide me some further details on this. I'm not sure what to do here, i don't want to get the counter party in trouble as well but on the other hand if she was driving without insurance / license it's not right !!!

    The Gaurds will do a check anyway and I would guess they asked for you both to produce insurance, licences, NCT if applicable....

    She will be done either way if they do their job right and rightly so.

    Get straight onto the Gardai about it.

    Why would you assume they didn't have a license, the Garda probably just didn't give it to you. With their insurance details you wouldn't need the license, contact the Guards and request further details and/or clarification.

    This happened to me, had to claim from my own insurers to get my car replaced (total write-off) and then claimed from the mibi to cover hospital costs and time out of work!!
    Driver got a driving ban and a fine and my premium trebled:rolleyes:

    They would not give a licence number....

    Name, address, phone number, insurance details that's it.

    The Guards wouldn't give you her licence number there's no need for you to have it and a major GDPR issue.

    The most likely thing that has happened here is that you have the wrong insurance company

    Put the reg number you have into cartell.ie to make sure it's a match, that's a start. Advise Gardai that the insurer has advised the policy does not appear valid. They can then check it. You always have recourse to the MIBI if it uninsured

    Can you tell me the name of the insurer and the format of the policy number (eg Zurich 01 PMV 1234567). I should be able to say if they match properly

    Yeah maybe you're right. However they took my license number and gave to her so don't see why they wouldn't give me hers?

    No point ringing an Irish insurer if the car isn't from here.

    Op information needs to be upfront otherwise we don't know.

    Yeah i had a look at the pictures of her Reg just now. I thought it was UK previously.

    Called the Garda, they concluded that she probably doesn't have insurance but the Garda who was on the scene will be in the station at 9 in the evening so they will ask them and get them to call us back.

    In the meantime i'll try contacting Spanish Allianz to see if the car is insured there.

    The MIBI will assist you in a claim involving an accident with an overseas motorist. They will contact their counterparts in Spain, who will then contact the local Allianz office

    It will be sorted, but not anytime soon I'm afraid
