    Good evening.
Can anyone advise on whether stamp duty is payable at the non residential rate if yoy buy a property with tenants who have a year left on their lease and you want to live in the house once the tenants leave?
    Any advice welcome.

    Thanks.

AFIK the rate of stamp duty is based on the type of property. If its a residential property, then I would expect residential stamp duty rates to apply. Probably worth checking with accountant/solicitor/Revenue to be sure.
