Non-resident landlord: use a Collection Agent or allow tenant to pay?

    Hi all,

    I'm an non-resident Irish citizen, and I rent out my apartment in Dublin.

    Re paying my tax, it seems that I can either use a Collection Agent (e.g. a family member) or get the tenant to withhold the 20% tax and do the tax return themselves.

    Any advice as to which is better / any risks or pitfalls?

    The tenant won't make your return - the only responsiblity the tenant has is to deduct the 20% tax, and pay that to the Revenue.

    You still have to file your own return - and either get a refund or pay further tax depending on your circumstances.

    Ah OK - thanks a lot for your insight.

    So better to use my brother as a Collecting Agent and do the return that way? (i.e. Seems simpler)

    A trusted collection agent, forget about the tenant, he will just deduct and possibly not pay it over

    Re collection agent: can I get the tenant to pay into my account or it explicitly has to be the account of another person?

    I previously rented from a non resident landlord. The 20% was deducted from my salary every month.

    It worked fine and I had no issues doing it, but I did note many years later that I had been paying it long after I moved from that house. I got it back on a tax review though :D
