Changes to Annual Leave Policy

    Hi Guys , just looking for some legal advise in ref to annual leave from work and changes ect,
    Here goes im working for same company 5nhalf yrs and we have 20 days annual leave per yr , anyways over the last few weeks they have hired a new head guy who is based in NYC , he has made some changes to how the days are approved etc.

    The rumor was floating about that annual leave would now have to be accrued, with this in mind i was looking at and booked a package holiday with TUI for 2 weeks next year flying on July 10th 2020 ,I had calculated that in order for me to take the days off i need it meant having no annual leave up to when i was due to go on hols , that was fine with me as it also gave me 10.02 days leave accrued Jan 1st to June 1st .

    Yesterday an email was sent to all employees stated the following changes are to be made Effective 1 February 2020, the holiday accrual year will be changing and effective immediately unaccrued time will no longer be approved. Holiday accrual year will now be February 1st – January 31st (rather than January 1st – December 31st)For January 2020, we will have a bridge where all holiday accrued in Jan 2020 must be taken that month. In order to facilitate this, the following applies:We will round up the holiday accrual for all CS team members to 2 days in Jan 2020 (i.e. giving an extra .33 days holiday to everyone)These 2 days must be taken at any time in January, this means in short i am now being forced to take time off in Jan i don't need and therefore leaving me short time off for July when I do need for the Holiday i have already booked

    Any advise greatly appreciated here

    Sorry I can't help in terms of the legality but this seems insane - are June and July buys/peak periods workwise? It basically means if you want to take a 2 week summer holiday (a pretty reasonable request) you will have to wait till August - surely this also means most people (especially with kids) will take their two weeks summer holiday in August as a result leaving the place potentially understaffed that month.

    Seems ridiculous - is there any way to send feedback to HR etc flagging such concerns and that your holiday was prebooked?

    Yes what you are saying is exactly what they are doing , as you said the whole or majority of the staff will want holidays in Aug and as I parent I’m limited to July and August months fir mine . June n July are no busier then what Aug is . As for HR they are no help whatsoever

    As far as I know once you have completed your first year in employment you can take all leave due to you from anytime from the start of the leave year. You do not have to accrue first. That would be a working time directive provision.

    I’m there over 5 yrs . The not being able to take the time off unless days accrued is not what’s even stressing me as I worked out I would have 10.2 days from jan 1st to June 30th by taking no annual leave , but now I’m only going to have 8.35
