Motor tax expired and selling car

    Would any one know what the procedure is on a car that hasn't been declared off road and tax is out. I'm selling the car. I don't mind if I have to pay arrears but I can't use the regular form in the tax office as this needs an insurance policy number and the car has been uninsured ( not using it) for a number of months. TIA

    Don't worry about it, it's cleared once new inner takes it and transferred onto their name.

    Fill out VLC then take a photo and you post it to the address on it free post also. Advise buyer to do same with photos especially all sides including front as code at top is very handy if lost

    Shannon address is on the form and write free post on it.

    Don't worry about it, it's cleared once new inner takes it and transferred onto their name.

    +1 the new owner only has to tax it from the first day of the month in which the sale takes place. No arrears payable by anyone.

    Just make sure that it doesn't get lifted on the test run. The tax is still liable till its sold and will ping ANPR.

    If your stopped on the test run have the story straight.
    It’s just been sold 5 mins ago.

    Your in the way back from th roost box after posting the VLC and that’s why you can’t show the nice officer a copy of it.

    Yes no arrears due. I know a seller who was conned out of the price of a years tax when selling as buyer convinced her that he would have to pay the arrears.

    On the test drive it is the seller's problem. Do you think a random stranger will lie to the Gatdai for a vehicle they don't own when stopped on a test drive? Especially when it means they are possibility opening up a possible no insurance court case, which does have points and large fine.

    €60 fine.

    Maybe gets lifted....
    Why you so worried I've bought many a vehicle with no tax and sold many also same....

    It'll cost €200 minimum to get it out of the pound and you'll have to back tax it. That's a lot more than the €60.

    Should we all trailer a car out of someone's yard because they chose not to tax it? Once it is insured and roadworthy then i dont see a problem in driving it just because the tax is out. Do we then leave the car sit in our drive just because we have to wait for the logbook to change over......i dont think so, again thankfully the Gardai have some common sense in these situations.

    Anytime i have bought a car with no tax i have had no issues when stopped. I was always allowed drive on......The Gardai used their common sense. See a pattern here........its called common sense.

    New owner has 10 days from the date of sale to tax the car.

    So only the test drive is a problem, but in 99.9% of cases people don't overthink it.

    You would have to be very, very unlucky. Just don't test your luck by driving too far and bear in mind that whatever the practice is, the car can be legally lifted if tax is 2 or more months out ;)

    New owner can also sign car off the road if bought say near end of month and then pay tax from the start of next month. 21 days is the time given to do so once changed into new owner.

    Keep a photo of all sides of log book and new owner do the same and guards in most cases will let you on.... Obviously of course there is a risk but that's on new owner not seller.

    Use to be 10 they extended this as many didn't get the VLC in the post and would miss the deadline.

    Many don't know you can tax or declare even if you don't have the VLC as it works once change of ownership is done and this can be found on motortax.ie

    It is actually either, if you go past 10 days you cannot declare it off the road any more.

    I would have to double check, but you are probably right that it would still be subject to tow/fine within 10 days if the tax was out for too long.

    I might have mixed it up with 10 days limit on displaying insurance disc, where you still can be fined for non display and then would have to appeal etc...


    The whole thing is a mess sometimes, but as mentioned before this kind of sales happen everyday and it is probably rare that car is lifted, unless someone is taking a piss.

    Earlier one of the poster mentioned common sense, and while it cannot be written into the law, I am sure both Gardaí and the citizens know where common sense ends and taking a piss starts ;)

    If they believe you to be uninsured say bye to the motor.

    21 days to declare off road.

    Only time a car can legally be driven on a public road when no tax is on the vehicle is once it's signed off the road and been used to get to a booked NCT appointment or home from appointment.... This is the case to allow anyone with a car not been used to keep an up to date NCT as nobody can drive a car without NCT as its an offence
