Non-compliance with planninng permission

    Do I need to amend as built. or can I apply for retention, in order to comply with planning permission and comply with An Bord Pleanala Inspector's report?

    Extension built almost twenty years ago. Best route to take? Please advise. Thank you.

    are you saying you built something that was expressly refused by both the planning authority and An Bord Pleanala ?

    Refused by local council. Appealed. Appeal granted by An Bord Pleanala subject to compliance with drawings as submitted to council for planning.

    Dug out file/drawings/inspector's report. Find some interior changes made.

    Hence posting here.

    Interior changes are usually fine as long as they don't affect the external appearance.

    You need to ask whomever is certifying what you have

    Verbal word from surveyor is need to comply fully in order for cert. of compliance to be issued.

    is that a question?

    its not that verbal word is required, its that the surveyor (engineer / architect / technician etc) must be happy to sign their name to the compliance certifcate document...

    therefore its their opinion that counts.

    Interior changes that alter occupancy / number of bedrooms could be an issue.
    What kind of changes were made.
    If very minor alterations, surely you can get a cert with minor alterations noted.

    Thanks for comments etc.

    As built does not comply - meant to be ancillary to main house.

    Doors shown on drawings do not feature, so no access to extension from main house.

    When asked/informed by phone, surveyor said best to make it compliant...presumably so a cert. of compliance can be issued.

    I'd rather comply than create problems for my family if that is the only route.

    Thats a significant issue.

    Its not an extension of its not connected.

    Best to put the door in

    Sounds like a granny flat that the interlinking doors were never put in.

    Yes, granny needed more independence from large family! Had no idea until file dug out about non-compliance.

    I'll get a quote from my friendly builder and get work done (unless price is prohibitive), assemble drawings, dox etc. and get surveyor to do a cert.

    Can you check with the original builder?
    I’ve seen it where the opening was put in, lintel in place but the opening was then simply boarded up, blocked up.

    It may just be a case of punching a hole in some studwork.
