Declare vehicle off the road: is my car space a private or a public space?

    Hi all

    I need an advice. I'm leaving the country soon for at least 12 months so I'd like to declare my car off the road.

    It seems that I could do that only if the vehicle is kept on a private place. Is my private car space in the estate where I live considered a private ora public space?

    I'm a house owner and included in the property there are 2 dedicated car spaces which are not gated/secured in any way. They are just off the road in the estate These car spaces are just off the road in the estate which is open to the public.

    Can I declare tha car off the road?

    Yeah it is. I just spoke with the Estate manager and he confirmed that car spaces are owned by the management company and leased to each property. So in a nutshell it is private space and I can declare the car off the road no problem.

    There’s a max of 12 months for the off road declaration I believe, you’ll need to renew the declaration before it expires

    Would a car cover solve your problem? Apart from the tax situation 12 months is a long time to leave a car out in the elements!

    Just be careful I've seen something similar where a car in our estate who's owner was over seas was considered abandoned and stickered saying as much - a month later car was removed on behalf of the management company-
    Gated apartment complex.

    I would strongly suggest informing the management company that the car will be left there unmoved for a long period of time.
    If the estate is using permit parking discs, make sure that you know when to renew the disc and have someone who can replace the disc for you at renewal time.
    Also give them the contact details of someone with a set of keys to the apartment (and the car) who they can contact in case of any emergency.
    If nobody is living in the apartment while you are away, have someone empty the letter box on a regular basis.

    I had this issue before, cars are deemed abandoned if the number plates are removed.

    Very true, had that happen to a car of mine before. Some wagon from Fingal coco pulled my plates off and sold the car to a scrap yard.

    Long story short, I found the car, took them to court and won.

    As a home owner who's entitled to two of the spaces, I don't see how parking your car there would be an issue. As others have suggested I'd give them a heads up and maybe get a car cover. Hopefully your neighbors aren't busy bodies and want to get rid of it as the spaces don't concern them. If the spaces aren't outside your own house/aren't numbered and you can claim any of the 2 spaces, someone may not take kindly to your car outside their door though.

    I wouldn't be too worried, I rented an apartment that had one space for each unit, off street parking like your own, and there was 3 abandoned cars. Two were there at least 6 months before I moved in and a third ended up being left behind while I was living there. Nothing happened to any of them apart from someone looking to buy them.

    That's only for public property. The ops car is on private property, run by a management company. He needs to make sure they know it's not abandoned. Otherwise, they'll use whatever they can to free up space. No tax, insurance, NCT would indicate car is out of use. Unmoved over a period of time would suggest abandoned too.

    Op, you need to check with your management company whether they require you to have insurance on the vehicle while you're away. I remember it being a requirement in my old apartment. If by some freak accident, or arson, your vehicle went on fire and set neighbouring cars alight you need to be covered. Also for damage to the carpark surface being repaired and fire brigade costs.

    Also have you anyone that can call and open the car windows now and then, the inside of the car will be an awful state being locked up for a year, will probably get covered in mould. I've seen other threads on here about what you need to do when leaving a vehicle stored for a long period of time.

    I did reply to your smart comment, regarding leaving a car in the one position for so long, it was rejected for language that I see used often here. I ALSO ASKED FOR MY ACC. TO BE CLOSED I have to wait and see! I am glad to see in your second paragraph that you copped on to what I was trying to advise the OP regarding what can happen leaving a car stationary for a long period!

    Your comment was about a cover being put on it to protect the outside, I'm saying that'll be fine, a quick wash will sort that. My post above was in relation to the inside which is a whole different ball game to clean if mould occurs.

    Gardaí will say it's not their problem to deal with. Council will also say it's not their problem to deal with.

    Yeah, they don't go by those rules in Dublin anymore.
    Council pass the buck to the Gardaí, Gardaí pass the buck to the council.
    Gardaí won't even bother ticketing an abandoned car on my street that has no tax, insurance or NCT.

    I never suggested either would be involved in removing it. I've advised to speak with the management company, becuase I've seen management companies remove vehicles before.

    Over inflate the tyres and put some dehumidifiers in the car (the small packed ones).

    Also, have as little fuel as possible in it, and disconnect the battery.

    When you return put all new fuel into it and potentially get it serviced.

    Make sure you keep car fully insured or you will lose all your ncb. I'd be tempted just to tax it to reduce hassle. Lend a friend the key and add them to insurance and let them drive it and keep it turned over and serviced.

    Check with insurer to make sure....

    Any agreement with an omc should be sought in writing or else be subject to change at any time as directors and policy changes.
