Penalty points

    Hi

    Hope i have posted in the right forum if not apologises and mods move to the appropriate forum if needed.

    I received 3 penalty points for doing 60km/h in a 50km zone back in mid January of this year. I was stopped by garda and he took my details etc. That was fine. However i only received the letter in the post in June and the points have gone on my licence now for June and not January. I have no problem with the points as i was speeding but i do have a problem with serving almost an extra 5 months on an offence that happened in January. It be now June 2022 before they come off and not January 2022.

    Can a complaint be made about this?

    But the points were only put on in June not January so you got 5 months off without points by your logic as well

    I did and i accept. Just the issuing of the offence took longer when it didnt need to.

    I suspect there is no published deadline for the issuance so you're out of luck I'd imagine.

    As far as he was aware his points started the day of his offence, not June. It's not his fault the incompetence of a state office in taking 5 months to issue points.

    Would the points not be put on when you pay the fine?

    Best thing would be to ring the rsa and ask them if they can change the date or at least explain to you why they cant

    Seemingly not according to the RSA website. A letter is posted with driving licence details and whether the fine was paid or if court case convicted. Only then from the date of this letter will penalty points be applied after 28 days.
    Which sounds fair enough it gives all departments a chance to cross reference and to let appeals run their course.
    But 5 months? Are they issuing that many points? They must be!
    When did you pay a fine OP?

    I paid it immediately when i received the letter but was wondering why it took so long to get to me. I have no problem with the fine and points but i do find it unusual to get letter 5 months later.

    they take so long because some people fight the points take it to court etc

    Interesting point. If you advised your insurance company (or had renewed in the meantime), you could have paid a higher insurance premium for an extra 5 months.

    More interestingly, if you had 9 points, and now got 3 points. Does this mean that you would be disqualified from driving, but could drive for another 5 months until the points were applied? (and in turn, you could have points come off your licence in that time, bringing you back below the 12)?

    I notified my insurance company straight away in January and my premium increased because of the points. Now my penalty points were put on in June and not January.

    I'd be getting into the insurance company. Best of luck with that.... Only hope would be you had a renewal in the interim I'd say.

    You inform your insurance company when you get the points, not after being stopped.

    That was your mistake, but obviously we don't get points every week so it isn't obvious for everyone.

    Well i got them on a Saturday and notified the insurance on Monday. I took it they were on my licence the day the garda stoped me and told me the letter would be send in the post. I just wanted to be straight in case i was involved in any type of accident and i hadn't declared i had got penalty points in the meantime.

    If you go pass a gosafe van, how would you k ów what the outcome will be?

    You can't report it until you get notification of the offence.
