Alleged unauthorised development, Planning Permission

    Looking for advice/ direction.
    My brothers neighbour has submitted an application (valid) for a two storey extension to an existing vernacular cottage (not a protected structure), 5 stables, sand arena etc. These proposed developments will have an affect on the amenity of my brothers adjoining dwelling.
    The neighbour previously (last year) extended the cottage to the rear.
    On examining the planning application it is clear to me from the drawings submitted that the extension constructed is in excess of 40m/2 and is not exempt and therefore is an unauthorised development.
    The Planning Application did not refer to the previous extensions, they were shown as part of the existing dwelling.

    My brother has submitted an objection in relation to the planning application.
    He has made a complaint that an unauthorised development has been carried out.
    The objection and UD complaint were lodged on the same day which happened to be the last day for submission of observations in relation to the planning application.
    The UD complaint was copied as part of the objection.

    Does the UD invalidate the previously validated planning application.
    Should the LA invalidate the Planning Application or will they give the Applicant an opportunity to regularise the situation within a request for Further Information.

    I will be requesting clarification from the Planning Authority early next week.

    I would appreciate if someone could point me to the relevant planning legislation prior to speaking with the LA.

    UD doesn’t necessarily in validate the current application

    The council may simply seek further info from the applicant

    The existing house is say 120m/2.
    The proposed extensions are 240m/2
    Total 360m/2

    Is it a requirement to note in site notice and newspaper notice amount of area of extension where house is been doubled in size or greater?
