Cancellation fee when ending contract early

    Can anyone say if they've had experience of avoiding a cancellation fee for a ending service which has been rubbish.
    I'm talking about a tv and broadband service which is horrendous and cost me hours on the phone to the service provider. The broadband may have been fixed finally (awaiting a 3rd engineer report) but at this stage they've admitted to me that the various tv issues aren't fixable...the box is full of 'bugs'.
    I have advised I want to cancel the service but it is not due to end until November. I am not sure whether to refuse to pay the cancellation fee (as really I feel the tv box comes under 'faulty goods' if promised features such as on demand, apps and record feature frequently don't work) and risk some sort of third party coming after me for the debt; or to pay the cancellation fee and maybe go to Small Claims Court after to have it reimbursed?
    At what stage should I argue that I shouldn't have to pay the fee?


    I am not looking for ways to dodge the fee illegally by the way. At worst I'll pay it just to be glad to switch providers but I would like a chance to fairly contest it at least.

    Use the SCP to claim for breach of contract thus far and look for the cost of the contract thus far to be refunded. You'll end up dealing with an escalations team who will be only too happy to let you out of the contract in exchange for you dropping the case I would imagine.

    So I followed your advice on the phone by threatening SCC with their supervisor and it worked. No cancellation fee. Out of contract when I wish. Many thanks.
