Commercial premises ground leve extended out back. Residential apartment upstairs not

    Commercial premises ground level extended out back. Residential apartment upstairs not.

    Who owns the space behind the upstairs apartment? i.e. I assume apartment but is this debatable? If apartment wanted to extend could commercial premises say "not on my roof".

    Yes they could, apartment wouldn't own it

    Depends on who owned the ground that the extension was built on....

    So technically they could. Depending on planning permission of course
