    I read this story a few weeks ago and while I found it hard to believe a judge could determine if a boat operator in the carribbean was negligent in this case, I honestly thought the claimant would get at least €20k for her broken arm but was delighted to see that he rules against her and rightly attributed blame to her stating that she knew the type of boat ride it was going to be and did not follow the instructions to stay seated.

    I hope we see more judges now taking the claimants own actions into more consideration when adjudicating on claims.

    I believe the whole media coverage of the Maria Bailey case have made judges more aware that their sometimes ridiculous awards are going to be more closely scrutinised and reported on and we might see people dropping cases which are due to be heard over fear of the bad publicity surrounding these cases, the threat of costs being awarded against them and also the threat that they may be prosecuted for false/fraudulent claims.
