Being forced to move roles

    Hi All,

    I wonder could I get an opinion on this please Ive worked for a software company a for over 8 years - It
    is owned by a parent company and was recently taken over by a competitor In the last 18 months the company I have worked for has been neglected (due to takeover) and is set to become loss making - As a result the parent company has decided to join company a into company b with me taking on the managerial duties of both however my terms are being effected.

    My base is standing still and commission/ bonuses are being reduced. I dont want this new role to be honest but I am basically being told I have no choice - it now transpires that they are keeping company a and b as separate entities.

    To me this doesn't feel fair -Any thoughts ?

    I doubt there’s much room for complaint.

    Your initial role had been done away with.
    You’ve been offered an alternative similar role (base is same, bonus doesn’t count) so it’s not a redundancy situation.

    You could possibly fight and say the content of the role is different enough to say it’s not suitable alternative but it doesn’t have to be an identical role so that would be a weak enough argument.

    Have you voiced concerns about not wanting this new role ?

    You might be able to fight it under the grounds that it's not a suitable role. If successful then they will likely make you redundant. You might get the legal minimum redundancy which isn't much.

    If you are sure you will get an enhanced redundancy payment or are happy with the statutory minimum then you could force it.

    Alternatively you could just start looking for a new job.

    I would recomend that you look for a employment specialist solicitor, as TUPE may apply, if your employment contract is being moved between the two companies.

    If you are remaining with the same company, how your contract is constructed will determine if the company can calculate a nil commission / bonus or it this would be a breach of the contract by the company.
