When effect of new BER Building Regulations?

    Hello all,
    Anyone know what the consequences/dates of the soon to be published Building Regulations around BER and near zero energy building? We've just got full planning permission a month ago and are wondering is there a deadline for us to get our Provisional BER done and commencement notice completed and sent in before we have to build to the new rules?

    These Regulations shall apply to works, to a building in which a material change
    of use takes place or to a building which undergoes a major renovation, where the
    relevant works, change of use or major renovation commence or take place, as the
    case may be, on or after 31 March 2019 except where -
    (a) a planning application is made on or before 31 March 2019 for planning
    permission or approval pursuant to the Planning and Development Act 2000
    (No. 30 of 2000) and where substantial work has been completed by 31
    March 2020;

    And does a new build fall under those same exceptions? So we don't have to have the BER and commencement done by this 31 March because we got full planing permission in February?

    No.

    The operative date is when permission is applied for....

    But remember the build must be substantially completed by 31 march 2020

    Only if you commence and Finnish by this time next year.

    And one other thing .. It shouldn't be called a "BER"... that's not what it is.

    It's a preliminary Part L report.

    (Just a bug bear of mine when it's called a BER.... A BER is something completely different)
