Asset value increase before probate

    Asset worth 200k at death.
    Lengthy probate and value for CAT 220k.
    Base cost for CGT is 200k.
    CAT assessed on 220k.
    Is this not penal as base cost should also uplift for future disposals?

    They are two different tax regimes.

    If it was not this way you could just delay the probate and "bury" the gain before probate.
