Police Certificate for job abroad

    Hi all,

I received a job offer from abroad and need to submit proof that I have no criminal record. I applied for a Police Certificate but the Garda station got back to me and said they cannot issue one for employment purposes. Garda vetting is also not an option because the job is abroad.

Anyone with a similar experience, sure there must be a way I can get a simple piece of paper to say that I have no prior convictions?

Would really appreciate some advice because I feel helpless with this process

Tell them a lie about what you need it for, eg say it's for a visa.

Friend is going to Canada. Had to go to Canadian embassy in Dublin to sort his visa. His local garda station gave him police certificate without issue.

I was required to get Garda clearance for a volunteer stint working with children overseas. I applied through dataprotection@garda.ie and it’s a request for your personal record as held by them and costs €6.35.
I will post the copy of the email I received for them with the instructions when I can find it!

I think it took about four weeks to come through, and it’s hard copy, not by email.

Hello, i have the same problem. Need for employment abroad, but Garda refused my request because they provide only for visa purpose. I was with data protection, got this certificate, but its nothing, its not proof that i have any convictions. And my employer didn't accept this data protection certificate. They said they need police certificate of good character. And I don't know what to do. If i have to go to garda again and say that i need it for visa, what will be in certificate? They need to know for which country? But for that country where i need certificate not need a visa.

I go the letter form data protection, it says that I have no criminal record and at the same time it says that you can't use it for Proof of No Conviction.

I spoke to my local TD and after some research he also told me to get the one from data protection.

I really don't know what to do any more..

Yes, i have the same as you on this data protection certificate, and to whom it may concern don't accept it.

Maybe try to go to garda and ask for consular authority. Only this way.

My employer overseas had no problem accepting the document. It is provided by the Garda, it refers to my personal details that they hold, it says I have no criminal record. I’m not sure what else could be needed?
When it says it can’t be used for proof of no conviction, maybe they referring to spent convictions? If they were live, surely they would appear as a criminal record?
Could your employer request your clearance themselves, as would be done for employment here?

Which document accepted your employer from Garda? Garda provide only for visa purpose, consular authority and business abroad. And never for employment.

If you read my earlier posts, you will see which document I am talking about. And my employer was an international organisation.

Oh, sorry, yes, i see. You sent them Request to access to Personal Data Protection. I have this also, and sent to organisation abroad, but they don't want accept it, because on this certificate showing "This document should not be construed as Proof of No Conviction, a Police certificate, a Garda reference or Garda Vetting.
So my organisation ask to send them police certificate that i have no convictions. And garda gives only for visa to travel.

A GDPR request should disclose anything that the recipient data controller (i.e. the Garda) are holding on you, if it is held in the format considered covered by the legislation by the Commissioners. The fact that you are specifically requesting information on a "criminal records check" as they have told you to request in their instructions, means they are specifically looking at a criminal records check. If they do not disclose something they are holding on you in that specific area after your request, they are liable to prosecution.
I'm not sure what else your employers are looking for and I'm not sure what else the Garda could be holding on record. But if you are sending an approved request for sepcific information, that has to be supplied.

Thanks for your answer. When i sent them form 20, there was no fee 6.35 as you paid, they said its free. I not understand why you paid and me not. When i got this document, i rang to their office in Enniscorthy in Wexford and explained that your document says nothing, but they in Wexford said this is right document and if i have no records, its means that i am clear and this document i have to send abroad for employment.
Is it possible that you send document what they sent you? Maybe you got something different if you paid for this. Thanks

Sorry Larysa, I don't have a copy of the document I received and I don't know what you mean by 'says nothing'.
I thnk I have answered the OP as best I can and don't really have anything further to add. I hope you get your request sorted.

I've also tried getting one for employment abroad but without success.

Does the Police Certificate show the exact same as Vetting? I know vetting shows convictions and pending prosecutions, but I haven't seen anything to say that the Police Certificate includes pending cases.
