Loans - Creditor direct debiting too much after verbal agreement

    Friend has a 19K loan for medical bills for their family over five years paying 416 a month.

    She has paid this for over three years now and due to unforseen circumstances was unable to pay October or November and didn't inform the loan company. Back on her feet anyway agreed to pay 416+ 210 for December and January and asked would she like the direct debit changed to when they she was paid. She agreed but firmly said to them that 416+210 is all that she can pay to catch up.

    However they took an additional payment of 416 for the original payment date for December along with 416+210. She rang them up and asked what happened and said oh, your nearly in credit now. All that will be taken out of your account now next month is 416+210. Next Month comes and they after taking the 416+210 on the new direct debit and another 416 on the original direct debit date.

    To be honest she is absolutely raging but needs good credit rating and doesn't want to me mess up with bank by recalling the direct debit and the money lender has told her it won't happen again.

    How can she go about this properly and who can she complain to.

    Check your loan agreement.
    Consider refinancing the loan at a lower interest rate

    She rang again today and I was with her. First Girl on the phone was lovely and then put her through to the probably the most horrible, ignorant person ever in accounts.

    Went straight into the loan saying you paid X amount and this was what agreed. Every time she tried to speak this nasty women's talked louder and faster saying the direct debit was always there, you made the additional payments , you made the additional payments and not part of the DD agreement. Friend tried to refute but the person on the phone got louder and angrier and rejected everything.
    Anyway we'll see now how it goes this month but what a horrible company. All she wanted to know would it go back to normal now and is everything okay. Horrible comoany. Am I allowed to name here?

    Don't name, but put the complaint in writing, take a copy of what she's written, and send it by registered post. Clearly state what debits should be taken, when and for what amount. Send a copy to the bank.

    Ring the bank and cancel the direct debit and pay manually in future.

    You wont get any money back from them. That's for sure.

    I think now she owes about 14K all together between loans, Credit Cards, Flexi, bank loan. She's going to credit union tomorrow to try and consolidate all into one and get back on her feet as she's sick of paying multiple companies

    It was money that was needed at the time and had no choice but to use loans
