Advice Consumer Law Claim - dryer.

    Hi all.

    I purchased a Dryer just under 2 years ago from a large online retailer operating in Ireland.

    I had a repair under the manufacturer warranty about 1 year ago for a similar issue.

    Essentially the drum does not heat and therefore the cloths will not dry.

    Anyway...

    I reached out to the seller firstly - they referred me to the manufacturer saying the product was under warranty.(Which I knew it was not as I didn't register for the extended warranty)
    I reached out to them and they confirmed that it was not under warranty and kindly provided some service options.


    So I went back to the seller and asked could they repair it under my consumer rights:

    Namely:

    "Sale of Goods and Supply of Services Act 1980"

    (a) of merchantable quality – goods should be of reasonable quality taking into account what they are meant to do, their durability and their price

    (b) be fit for their purpose – they must do what they are reasonably expected to do

    They have informed me that:

    "According to you consumer rights, the minimum warranty time is one year, and I am sorry to say that the manufacture only offers one year without registration.
    Please, feel free to check your rights on the citizen information website, the 1980 sale of goods act or the competition and consumer protection commission pages below."

    What are your thoughts on this? Would small claims court be my next step? Luckily I have all of this in writing and it would be easy to show the evidence of my conversations with both the manufacturer(Who is not liable IMO) and the reseller.

    2 year warranty under EU law, thread on it in this forum. Responsibility lays with final seller. Use the small claims procedure if you're not getting any joy with retailer.

    So another quick question: Before doing the small claim, should I have a hardware report from a service provider or would it be fine to go ahead without it? Also if I did need it and won the claim would the cost of the report be returned(80 Euro).
