Refund of motor tax (Garda/witness)

    My car has been scrapped.

    In the RF120 form its says "signature of Garda/Witness" is needed

    Can I just use my accountant or somebody like that instead of a Garda?

    Sorry if it's a dumb question

    Don't know what this witness is supposed to do, maybe just witness your signature and the EOL cert
    Do you have an end-of-life certificate?
    Did the car have more than 3 months tax left?

    To answer the question actually asked, I was in the same boat and was told I needed the signature of a Guard, Peace Commissioner or Solicitor

    To answer the question actually asked, I was in the same boat and was told I needed the signature of a Guard, Peace Commissioner or Solicitor

    Only the Gardaí can sign the form as they must also counter stamp the form, it says "Garda/Witness" because the Garda is witnessing the declaration.

    A Garda, Peace Commissioner or Solicitor is what I was told when I called them, the reason I asked was we have a Peace Commissioner living on our road so I got him to sign it. Although as with everything Irish I could walk in with a form stamped by a Peace Commissioner and not have an issue and then you send one signed by the same person and be refused

    But the stamp MUST be from the Gardaí, that is the prescribed form under law, namely the The Road Vehicles (Registration and Licensing) (Amendment) Regulations 1992 as amended.

    A statutory declaration which can be signed by a Peace Commissioner etc is determined by the provisions of the Statutory Declarations Act 1938 and the refund of motor tax declaration is not prescribed for anyone other than Gardaí.

    The problem is you may get someone in the motor tax office who will just accept this and proceed with refund, or you may get someone you rightly points out the Gardaí must sign/stamp it.
