I am looking at buying a new car. I have paid a small portion of the deposit (10% of the actual deposit) nothing is signed, nothing in writing.

Can I pull out of the deal and get my deposit back?

If the dealer is sound I'd expect so, these things happen. Once you haven't made some kind of obscure factory order there shouldn't be an issue.

No, not a bespoke order or anything. Car was already ordered and on the way to dealer anyway. I suppose I can only ask.

I suppose the ball is in your court as nothing signed they should return it to you in full.

Would they have any grounds for keeping it and not returning it to me and forcing me to continue with the sale?

Or keeping it as non refundable letting you decide to continue or walk away empty handed.

Nah, there's no way they could force you to follow through with the purchase. They could keep the deposit though but it is unlikely.

Thanks all. I probably worded that wrong, I know they can't force me through with the sale, but I will be buying a car regardless. If they return the partial deposit, happy days, I'll go elsewhere. If they decide it's non refundable then I'd be better off overall just continuing with buying the car from them.

What is the point of a deposit if they are just going to hand it back ?

The deposit has served no purpose at all.

The dealer should not give the deposit back

If your not happy with buying the car then don't go ahead with it. I'd rather lose a deposit than buy a car I didn't like or want, only to end up losing more money in depreciation when you sell it because you cannot stand to look at it anymore.
