Sale of NO-ALCOHOLIC beer after 10 PM and the supply of said to under 18's

    Just a legal anomoly I'd like to discuss. I don't want to get into a discussion around the 10PM rule. I imagine it'd just go around in circles!



    When I was in a local supermarket recently I was purchasing some non-alcoholic Erdingers at 11 PM. The girl at the checkout asked me for ID because the till told her to (I have to admit I took it as a compliment :D, I'm touching 28 and she was about 18 :pac:). She then scanned it, and the till would not process the sale!


    I was chatting to her for a bit and she couldn't apologise enough. It wasn't her fault, I know. Out of curiosity, I grabbed some vanilla extract that was sitting beside the till conveyor belt, I asked her to scan it and see out of curiosity.... It scanned through!


    So it got me thinking. People might argue that the "non-alcoholic" beer has a miniscule amount of alcohol (however small), and therefore must be subject to the 10PM rule. But, shouldn't the vanilla extract be subject to the 10PM rule too then?!(it's 40/50% alcohol), and what about Jack Daniel's sauce to? Some citrus fruits naturally ferment alcohol even! Besides, beers of less than a certain value (0.5%) are not subject to alcohol excise duty.

    Certain countries in Europe define an alcoholic beverage as one in which there is >=0.5% alcohol by volume, drinks below 0.5% ABV are not considered alcoholic beverages at all.


    So what's the legal situation?

    Vanilla extract food colouring, on a small shelf at the conveyor. Don't know why you're implyng that I'm making it up. I've nothing to gain from lying.

    I'm new to this website and I'm just noticing there's different sections. Perhaps it can be moved to a better suited section? If there's a law or consumer onw. Any idea how I can go about moving the location of the thread?

    Jack Daniels sauce also won't go through in most supermarkets. Also some festive minced pies as they had alcohol I found out.

    Vanilla Extract and food colouring are two very different products. :rolleyes:

    The reason Vanilla Extract is not treated as alcohol is because it is non-potable - try drinking it straight!

    Of course they would. The OP is one of those people who open the cord or whatever the shop uses and helps themselves. They know better.

    Fines are high for retailers who sell after hours. So it's easier for them to classify everything as being alcohol rather than have to inspect everything and determine whether it falls under the minimum alcohol threshold. Of they make a mistake then they stand to lose a lot more than they will make from selling non alcoholic beer.

    The likes of Heineken 0.0 have no more than 0.05 abv. A banana would have similar. It shouldn't be subject to 10pm rule imo. There should be be incentives for people to drink this if anything.

    No need. I can answer it here. The shop has no legal obligation to sell you anything.

    There is no legal restrictions on the sale of non-alcoholic beverage. Vanilla extract is not a beverage.

    The reason you couldn't buy it was probably due to a lazy implementation in the point of sale software where say anything with "beer" in it's title or description is prohibited from sale outside licensed hours. This may be also justified from a staff training perspective o make things simple - all beers inc. non alcoholic are prohibited after 10.

    And if course, the shop doesn't have to sell you anything
