What does "divided horizontally" mean?

    Hi All,

    A typical house (e.g. semi-d) does not need a Fire Safety Certificate, however a building containing flats does. This is in accordance with the Building Control Regulations (Amended).

    The definition of a flat given is "separate and self-contained premises constructed or adapted for residential use and forming part of a building from some other part of which it is divided horizontally".


    So the question is - does a duplex (i.e. single storey self-contained flat at ground floor level with another flat on top which is accessed at first floor level through an external front door via an external staircase) defined as a flat as per this definition?

    Yes, that's a flat.
    Horizontal division is the ceiling of one flat being the floor of another flat.

    You'll need planning, fire cert and disabled access cert to construct this type of building.
