Does speed camera vans check for tax?

    My mother was fined for motor tax out of date. It was but she was not pulled. Do the vans do that?

    EDIT - she was probably parked on the street and a traffic warden fined her.

    No, usually happens from being parked in a public place and either parking warden or Garda reporting it.

    If it was a Traffic Warden they would have ticketed her.
    A guard does not leave a ticket. On the odd occasion they will leave a pre-printed notice just letting you know that they will be issuing a Fine, but it's not required by law.

    That's the thing, where it says her car failed to display tax she would never be parked. It's in the middle of nowhere down the road from her, that's what got me curious.

    What about an AMPR equipped squad car? Do they have to pursue and pull or can that come in the post?

    They would have to pull you AFAIK. The offence is "driving an untaxed Motor vehicle" (or pretty much words to that effect).
    Therefore they must ascertain who is actually driving the untaxed Car.
    If it's just parked in a public place without Tax they can just Fine the registered owner.

    Yes you can be fine.
    It happens someone I know and it wasn't parked in public place

    Is it not "failure to display a motor Tax disc, whilst in a public place", IE, you don't need to be driving?

    I don't see why they'd have to pursue you, they've seen an untaxed car on the road, why would they need to stop you?

    I don't see why we need tax's discs at all to be honest. All this harping on about the environment, yet this instance on paper discs for everything that a computer can do in milliseconds, and if your totally not convinced a VIN number check can be done.

    As an example, my disc in my car window is 10/18, yet I taxed it 02/01 and no disc yet. So my back tax is paid and 3 months is pay yet cause of some stupid disc it looks like I am out of tax.

    I was pulled over in a similar situation and was a little taken aback because I knew I'd paid the tax a few months previously but the disc got lost in the post and it never even registered with me that I didn't have a current disc.

    I had passed a parked unmarked car at low speed, no way in hell they'd eyeballed the disc so it must have been the camera. All databases should have shown the car to be taxed but they pulled out behind me and next thing the blues and twos were in action.

    I was a bit perplexed at the scene but checked my emails and bank statements later and sure enough everything was paid up. Went into the local copshop to get it checked out and the car showed up as taxed for them.

    AFAIK there are two different offences;
    (a) failure to display a current Tax disc, which doesn't necessarily mean the Car is not taxed. This is the offence where Traffic Wardens (and guards) can issue a Ticket to a Parked Car.



    (b) driving an untaxed Vehicle (again, or words to that effect). This only applies to the Driver at the time, not the Registered Owner. Therefore a Guard would have to stop the Car to confirm who is actually committing the offence.


    Even in post #16 the link shows that the guards had to actually pull the Car before doing anything.

    would it not be the case that they could issue the fine to the registered owner who would have the choice to pay the fine or inform the Gardai who was driving?

    100 Garda stations without computers.


    Once the Gardai catch up we can drop the paper. Same way once the busses got leap readers the paper FTPs could be phased out.

    I believe that only applies to speeding offences. It was probably included in the legislation when private operators were introduced.
