Right of way???

    Hi all, you guys may be able to advise me correctly, I own a small plot of land behind my own home it's currently unused and .3 of an acre. The road it's on I believe is private ie. not taken over by the council but owned by a local farmer who has Agri land at the end of the road to the left. The road behind my house has other houses on it and on the land registry map it shows this road is hilighted yellow, does this mean because the other houses have a right of way on this road that I also have the same rights...I ask this because my brother is considering on buying the site to build and checking for potential obstacles etc... thanks in advance

    No unless your folio also has the right registered on the owners folio you don’t have the right. However if a neighbor already has secured right of way I’m sure the owner would also grant you it. You need to talk to owner and then get solicitor to draw up legal document.

    Appreciate the advice, spoke to solicitor today and advised of same, heading cap in hand to owner this weekend hoping they're not gonna look for "compensation". Thanks again

    Don't mention that your planning on selling or building on it.
    Or compensation will definitely be looked for.
