    Can anyone advise me how to appeal it ? I was supposed to drop my licenece and insurance cert within 10 days which I didn’t do and now apparently I’m banned for 2 years ?

    Assuming you did turn up in court, you could have presented the documents then and show they were in order.

    So there is a gap somewhere.

    Contact a solicitor, anything else is a waste of time.

    Well ya the only gap in there is I didn’t show up in court either. I was in England at the time for a very important coarse for my career..

    I simply want to know what my next step is , I was insurered with a valid Licence at the time so why should I lose my licenece?

    And for the record I went down with my Licence and cert on the 10th day but they were closed when they were supposed to be open. They open for 3 hours a day in my town

    I have open drive in my policy. The car in question had a full window and I had permission from the owner also

    Op depends what you were doing.

    Does your friend have open driving. IE anyone can drive their car on their insurance. If so were you in compliance with their terms of insurance?

    Or

    Were you driving the car using your third party extension? If so are you sure you were in compliance with terms of same?


    You having open driving does not allow you drive other cars.

    Open driving is when anyone else can drive your car.

    Driving other cars extension is ability for you to drive other cars.

    Is it a full licence you have? Is it fully comprehensive insurance you have?

    For the story, please confirm.

    Stopped driving at a checkpoint. Garda asked for your licence and insurance cert? (Full disc in window)?

    You had neither on you so were allowed to show within 10 days?

    Arrived on the 10th day and it was closed. You then waited for the court date and didn't go to court? You were overseas at the time (have evidence to prove this, and that it was critical to your future employment/education that you needed to attend).

    How were you then advised you were bannned for 2 years?

    Ah ok. So basically you got a 2 year ban and conviction for driving with no insurance, as you didn't prove you had any. (In the way they wanted anyway).

    This will cost you money but I am sure a solicitor can appeal the conviction and you can apologise for wasting the courts time. You will need a solicitor though.

    I had nothing with me when I got stopped , fair enough that was my fault. What isn’t my fault tho , is going down with my documents and then so called guards not doing there job, so as far as I’m concerned there should never have been a court case. And yes I can prove I was abroad. I’ve a full licenece and I got a letter informing me about disqualification

    Whatever you do, stop driving until this is sorted. Otherwise you'll get a valid disco conviction.

    Solicitor is best bet. Once you can show you had everything valid at the time, you had a genuine reason for being abroad that you couldn't miss (employment/education importance) a solicitor can help you appeal. But currently, you are disqualified so don't drive, either your car or your friends car.also, make sure your friend is aware of this, incase they get stopped in their car and it's flagged on the system.

    Yes she had her own insurance displayed but didn’t have my own cert with me stating I could drive other cars

    The Garda did do their jobs. Hence you needed to produce documents. What they are not required or expected to do is sit waiting on any particular day to facilitate somebody bring these documents.
