Section 5 application

    Long story but basically I have a 1950s house that has an unusual feature. It is a bungalow with a bedroom window facing into my neighbours side passage. All the houses were built the same. I applied for planning permission to divide that window into two smaller windows and make them obscure as I was changing the room into two bathrooms.

    I was granted permission for my extension at the back but the two windows where clearly stated as a condition that permission was not given to replace the single window to smaller windows that will be inside of the footprint of the original window.

    The neighbour objected to the planning and his observation was noted. The planning said that was not sufficient information about the window to grant permission or not.and not clearly stated on site notice.

    So now I have to fill-in a section 5 planning application. I can’t afford to keep going with the architect. And I think I would do a better job myself anyway!.

    My question is do section 5 drawings have to be ArchiTects drawings or can I just draw myself? They just need drawings of the window that I want to replace as it exists and what I want to replace it with.

    I now just want to replace it with one window exactly The same size but divided in the middle with the bar and two top openings one on each side. It would be obscure glass and the current window has clear glass.

    I am been given conflicting advice from planning. I am being told I don’t need planning permission for this and then I am being told in the planners report that it could end up being a civil matter.

    Any advice before I make the application? Can I do it myself??

    Yes, you can prepare Section 5 drawings yourself. A basic drawing would be fine and more importantly, photographs. An site location map also required.

    From what you say, I don't think you need planning permission to do what you want to do (i.e. split an existing window ope into two). However, to be sure, Section 5 is probably way to go.

    You don’t need planning to replace the window.
    But you may need access from the neighbor to fit the new window.

    This is where you may have to go legal if they don’t allow.

    Op could fit window from inside if neighnour is acting the b******s. Make sure new window is beaded internally. Leave the glass out. Fit window & seal all round the frame / reveal junxtion. Then fit the glass. Let neighbour clear up any debris if anything falls on their side. Who'd have neighbours!
