Removed from site for making a complaint to HR about supervisor

    So last week I made a bullying and harassment complaint to HR about my supervisor.
    Today, I went to the outcome meeting with my line managers to see the result of the complaint.
    The result is, I'm been moved off site while the supervisor gets a warning. They told me there's insufficient evidence to prove he bullied and harrassed me and it's in the companies best interest to move me to another site that I've already been on and wanted out of.
    We had a meeting last week where I asked whether this complaint would jeopardise my current position and they said no.
    Is there anything I can do or say ?
    I'm really thinking of handing in my notice because of this as I feel like I'm been punished for making the complaint.

    If I understand correctly, you already wanted to move to a different site?

    Or are you saying you were already on that other site and you didn't like it?

    Did you have any representation at any meeting?
    You could argue that such as move is unacceptable to you and if they try to enforce it you would resign and would take a case for constructive dismissal . But really you need advice from your union.

    how many other sites have you expressed dissatisfaction with in your time there?

    HR will support the management of the firm within the legal and financial requirements, but if there's a pattern of disruption from an employee they will also advise on the best way to cut their losses. This could be their approach here.

    OP is the job on the other site the exact same one as what you were doing on the site you're moving from? And how long have you been on the current site versus the supervisor?

    Look to be honest, if they can't prove that the bullying and harassment you allege took place, happened, then the company is trying to ensure the issue doesn't arise again. They can't punish the supervisor if there is no evidence and if the supervisor is longer serving on that site with no other issues, then it makes business sense to move you. The fact that you didn't like the other site is beside the fact. If you say that you don't like that site, it could be seen that you're the problem and not the site or the supervisor. Not saying you are but perception.

    You're not being punished for making the complaint.

    Not sure if it's possible, but you could say that you're happy to stay on the current site if your contact with that particular supervisor is limited.

    When i started with the company in January they put me on to a site, I asked to be moved from that site as I wasn't been challenged enough so they moved me to a new site. I made a complaint about the supervisor in the new site and now they are moving me back to my original site

    Looks to me as if they are trying to push you to resign. I'm not sure "not being challenged enough" would be grounds for constructive dismissal.

    OK. So let's go through the facts as you've presented them:

    - You feel you were bullied so you complain.
    - Company feels there isn't enough evidence, so as a compromise they will separate you and the supervisor. This means you have to move to a different work location, rather than the supervisor. You have previously worked at this work location and did not like it.

    This leads me to a follow up question:

    At any stage did you say you cannot work with this supervisor anyone?

    Well, look at this from the company's perspective;

    You've made a complaint about your supervisor. There's insufficient evidence to back up your claim, so now the company has an issue where you both keep your jobs, but it will be difficult for you and this supervisor to work together.

    Resolution: Ensure you and the supervisor are not working together.

    Options:
    1. Move the supervisor, disrupting all of the employees and management he works with daily.
    2. Move you, and only disrupt you.

    These decisions come down to simple things like that. Don't take it personally. If there is another comparable position in the current site where you'd never have to deal with this supervisor, them you can ask why that wasn't an option for you.

    But outside of that, there's not much you can do.
