get fired without warning writing

    My first mistake is to packed wrongly a ham in a bag. And my colleague show me how to that and on this Monday I made a sandwich I filled it with cocktail sousage instead of big sousage and the manager give a virbul warning. and today I made a pizza for woman who was in hurry but before made pizza all of the cheese was gone and I needed to take cheese from a fridge that is in upstair. The customer complains about this issue she was late her work. After that I went manager office and they said they don’t give a job and fired me so they will give me the p45.



    My question is they can fire me because in the contract company disciplinary procedures there are 5 stage about it
    1 employee counseling
    2 verbal warning
    3 written warning
    4 final written warning
    5 dismissal

    Do I have a right to sue the company ? I consider to do that. I feel really blue.
    My apologies if I have written any wrong things about explanation

    You have very few rights as you are only recently employed, I suggest you move on and find another job, you will not be able to sue this company

    Of course I will try to find a new job but, according to the contract all of the process didn’t occurred. And also is there any least limit weeks for that.

    Did they give you a reason for dismissal or just let you go. Why it is true that unfair dismissal legislation doesn’t kick in until after 12 months, if they dismissed you for any grounds under the equality act such as race, family status, sexual orientation, gender etc then this would be actionable. Now I am not saying this is what happened here but if there is evidence of above then you should seek advice.

    Have you followed all the food hygiene laws?

    It might be the issue not using the wrong sort of sausage.

    They told me that customers who complained about me live in the town and local people know each other so that they can’t have any chance. I understand them but my question is they don’t follow the disciplinary procedure why they add this policy in the contract and why I signed if nobody care this rules?

    We always have to follow the hygiene laws such as i always clean up chop boards and knife with blue for every customers.

    If you have a read of the disciplinary policy there will be a clause somewhere in it stating that the company reserves the right to initiate the disciplinary procedure at any stage depending on the level of misconduct. Just because the stages are there, no company ties themselves to going through each before termination.

    Given you are only in the job since October you generally don't have rights under unfair dismissal law. I would put it behind you and move on.

    Your only there a few weeks, you can be let go for any reason they don't need to go down the disaplinary road....get another job maybe not in food preparation.

    Didn't you post in the past about getting fired from a kitchen after 2 days? Maybe stay away from the food industry if you can.

    It makes no odds that's only company policy they don't need to apply it to a new starter. They can just let them go without reason without following the policy.

    Lets see if we have this right so far.

    Since joining you have been fired from your last 2 jobs within a very short time.
    Also you have had a "bicycle accident"

    Each time you have come to the boards looking for advice on how to sue or receive compensation.

    Maybe I suggest you return to where you have come from as you seem to be here to receive an insurance/compensation or anything by the ways of a free walk.

    Do you think your employers can see what you are up to and get rid of you before you become a liability?

    Large sausage in a sambo is food safe but cocktail sausages are not? What? I would imagine it has something to do with the cost and markup of the items.

    Sucks that you got in trouble for somebodies poor time management. I would just move on OP, there's very little you can do here really.

    Hi Op

    When you are on probation period the employer can release you from their employment without having to follow the disciplinary procedure to fire you. however that is not being 'fired' in the traditional sense. It's more like - 'sorry its not working out'. The employer can terminate employment, and not give a reason.

    in addition the law Unfair Dismissals Act, 1977 only applies after 12 months of continuous service.

    Now i'm sorry to say this, but you need to impress your employer when on probation period, to get permanent status. It is obvious from your initial post that this was not the case.

    Nope, just a sponger!

    Most "economic migrants" are thankful for the opportunity, work hard and look after their job. This guy could not give a toss for his job, regardless of where he is.
