FPN on wrong car?

    I'm posting on behalf of my dad who received a €40 fixed penalty notice (+1 pp) for parking on a footpath on Mayor Street, Dublin 1 on a Sunday in late October.

    The thing is, my dad lives in Kildare (near the Offaly border) and very rarely goes to Dublin; he said he wasn't in Dublin at all on the day of the "offence".

    The fixed penalty notice only has the registration plate of the car listed on it and nothing pertaining to the make, model, or colour of the car. He asked in a local Garda station about it and they were little to no help. They basically said he should pay it and then can appeal. :mad: I'm not sure what he has done so far but he said that he tried to appeal but it was unsuccessful.

    I'm afraid that he's going to pay it just to avoid the "hassle" of having to go to court even though it 100% wasn't him. I'm not sure how he can prove that he wasn't there though, he was in Naas hospital earlier that day (and signed in/out) but returned home shortly afterwards.

    Any advice on this would be much appreciated.

    There’s a reference number in the ticket numbers and digits. Email basically what you’ve said here and outline, include a copy of his appointment letter. The make and model of the car. See where that goes. It may be a mistake or cloned registration plate.

    Call the number and ask for a photo of the car, they must provide one if issued by a parking warden. If it was issued by a Garda they don't need a photo, if it was call the Garda and ask him/her the make and model of the car he/she ticketed to see if it matches.

    If it's a Garda ticket, then the fields for vehicle make model colour and registration number must be completed and must match the vehicle file on PULSE, otherwise the FCPN office return it to the issuing member for clarification.

    A cloned reg is entirely possible in this circumstance though.

    As above I'd email the office on the notice asap really

    A FCPN does not have a make, model or colour field, just the registration number.

    The copy the Garda fills in either the hard copy in writing or the electronic version that traffic use, would have this information. The office in Thurles can verify what make model and colour that was submitted to then was, for the OPs father.

    He told me today that he applied for a cancellation but was turned down on the grounds that the details of the depiction officer are correct :confused:

    It happened on Mayor Street Upper, which I think is Dublin 1 so store street would be the issuing station. The notice doesn't have the name of the garda on it either. Just the reg it seems.

    Is there any way that you could prove that your fathers car was somewhere else around the time of the offence? Maybe a witness or some CCTV showing the car at a different location? Would that even stand up if you refused to pay the fine?

    We've been racking our brain on this one but to no avail. He was at home at the time of the "offence" as it was after 10pm & lives in a rural area with no CCTV. The only thing he said was that he was down in the local chipper that evening but it would have been a few hours beforehand.

    It happened to me before. Done for parking when I was in work. My employer provided a written statement confirming I was in the office at the time and that my car was observed by CCTV entering the car park and leaving that evening.

    However, no sh**s were given. Went to court expecting it to be thrown out but only managed to get it adjourned and was asked to come back with more evidence showing it wasn't me parked there. I didn't know what else I could do so just paid the €90 to close the matter.

    They don't take the VIN when issuing a ticket do they? (It was Fingal CoCo who issued the ticket)

    you should have appealed again for sure. The default reaction seems to be to reject appeals.

    True, imagine walking up to Store Street and showing them your google maps timeline. You'd either be met with a blank stare or laughter. What would it prove apart from your phone wasn't at Mayor Street at 10pm.

    This happened to me about 2 years ago. I got a ticket for parking in Ennis of all places. I phoned them, and then sent in a letter stating that I wasn’t anywhere near Ennis at the time, and included my work travel log, including having gone through the m50 toll less than an hour before the offence. They struck it out and I didn’t have to pay. Never found out if it was a typo or a cloned plate, but since it’s never happened since, assume it was a typo.

    I live near that office in Thurles, it’s beside Staklums Office Supplies on Parnell Street. I’d literally be kicking the door down on that place if it happened to me. They are running an extortion racket/scam from that office literally.

    I have heard of people getting FPN for offences in places they’ve never actually been to. In one case a person whose car was either torched/electrical fault and with the insurance company got a FPN for a date long after the insurance company had collected the shell.

    Who’d have cloned the plate of a 1993 Starlet?

    The majority of people would have no evidence to appeal this and pay up sadly. It’s not typos or cloning going on. It’s maximising revenue through fraud.

    It was a few years ago. I've since gone on to study law so if it happened now then i'd make a lot more noise about it. Back then I wasn't clued in with the legal system and just wanted it to go away.
