Illness Benefit Eligibility

    My OH has paid tax every year for a full year bar 2016 as we lived overseas for a year. She has been rejected for illness benefit on the basis of no tax contributions in the relevant tax year(2016). My reading the below makes me believe she is entitled to it on the basis of having enough contributions in every other tax year referenced below. I just want some opinions if I'm possibly reading in incorrectly.

    It's taken us 8 weeks for someone to respond to us from the department and a lot of expense in phone calls and two visits to the local office.
    To qualify for payment of Illness Benefit you must satisfy the following twoconditions:

    You must have at least 104 weeks of PRSI contributions paid since you first started work

    and either

    39 weeks of PRSI contributions paid or credited in the relevant tax year, of which 13 must be paid contributions. If you do not have 13 paid contributions in the relevant tax year, then 13 paid contributions in one of the following tax years can be used instead:

    Either of the two tax years before the relevant tax year

    The last complete tax year (before the year in which your claim for Illness Benefit begins)

    The current tax year

    If she had 39 credits ( say she was on JSB or IB ) in 2016 then she could use the actual contributions from 2015 but she doesn’t have the credits either.
    2016 is the key year.
    Edited to add: it’s not the tax it’s PRSI that your looking at.

    Ah so basically even if she has PRSI contributions for every other year then it doesn't matter if there is zero contributions in 2016. That's a bit of a pain, thanks for the reply though.
