    Hi

    I have recently had an inquiry about selling a site. Just wondering about the process without an agent. Could it all be done through a lawyer?

    Yes. There's no obligation to use an agent. You can instruct a lawyer and the buyer can instruct a lawyer and away they go.

    But note your lawyer will do what lawyers do. He or she will not do what estate agents do. So what the estate agent would normally do, you'll have to do yourself.

    But apart from finding a buyer and marketing what else could an agent do?

    If I have a buyer and we agree on a price, all we would need should be a lawyer to process the deal?

    The third thing is assist you in price negotiations, but if price is already locked in you don't need that. The fourth thing is research to answer queries about property that buyer may have but, again, you may not need that.

    The agent will often draw up a heads of agreement which sets out the key terms of the agreement, you can do the same because its not legally binding, you'll find plenty of examples via google.

    The document is very useful because it gets everyone focused on the key terms and if a party isn't willing to sign it, then its warning bells. Its also very useful because it instructs the solicitor on whats already been agreed so can reduce a lot of over/back queries.
